AMENDMENT TO HOUSE BILL 1549

2    AMENDMENT NO. ______. Amend House Bill 1549, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Good Samaritan Act is amended by changing
6Sections 10 and 12 as follows:
 
7    (745 ILCS 49/10)
8    Sec. 10. Cardiopulmonary resuscitation; exemption from
9civil liability for emergency care. Any person trained
10currently certified in basic cardiopulmonary resuscitation who
11has successfully completed training in accordance with the
12standards of the American Red Cross or the American Heart
13Association and complies with generally recognized standards,
14and who in good faith, not for compensation, provides emergency
15cardiopulmonary resuscitation in accordance with his or her
16training to a person who is an apparent victim of acute

1cardiopulmonary insufficiency shall not, as the result of his
2or her acts or omissions in providing resuscitation, be liable
3for civil damages, unless the acts or omissions constitute
4willful and wanton misconduct.

7    Sec. 12. Use of an automated external defibrillator;
8exemption from civil liability for emergency care. As provided
9in Section 30 of the Automated External Defibrillator Act, any
10automated external defibrillator user who has successfully
11completed training in accordance with the standards of the
12American Red Cross or the American Heart Association and who in
13good faith and without fee or compensation renders emergency
14medical care involving the use of an automated external
15defibrillator in accordance with his or her training is not
16liable for any civil damages as a result of any act or
17omission, except for willful and wanton misconduct, by that
18person in rendering that care.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
