AMENDMENT TO HOUSE BILL 1461

2    AMENDMENT NO. ______. Amend House Bill 1461 by replacing
3line 25 on page 4 and all of page 5 with the following:
 
4    "(430 ILCS 65/8.3 new)
5    Sec. 8.3. Secondary schools and institutions of higher
6learning may report mentally erratic or violent behavior by
7students and former students to the local law enforcement
8agency. Secondary schools and institutions of higher learning
9that wish to report mentally erratic or violent behavior by
10students and former students for purposes of revocation of an
11individual's Firearm Owner's Identification Card shall first
12report the incidents to the local law enforcement agency of
13jurisdiction. Upon investigation of the purported incidents of
14mentally erratic or violent behavior, the local law enforcement
15agency of jurisdiction may report the information to the
16Department of State Police. The Department of State Police may
17use such information to determine whether to deny an

1application for or to revoke and seize the student or former
2student's Firearm Owner's Identification Card under paragraph
3(q) of Section 8 of this Act. If the Department of State Police
4acts to suspend or revoke the student or former student's
5Firearm Owner's Identification Card, the local law enforcement
6agency of jurisdiction for the secondary school or institution
7of higher learning where the incidents of mentally erratic or
8violent behavior occurred may seize the student or former
9student's Firearm Owner's Identification Card and forward it to
10the Department of State Police. The administration of a
11secondary school or institution of higher learning that reports
12mentally erratic or violent behavior to the local law
13enforcement agency of jurisdiction who subsequently reports to
14the Department of State Police is presumed to have acted in
15good faith and is immune from civil or criminal liability for
16making such report and the consequences of such report.".
