SYNOPSIS AS INTRODUCED:
 
New Act
20 ILCS 2605/2605-595 new

    Creates the Illinois Police Canine Certification Act. Creates the Illinois Police Canine Certification Board. Sets forth the membership of the Board. Provides that the Board shall establish requirements for certification of police canines used by law enforcement agencies within the State. Provides that the requirements shall be adopted by the Illinois Law Enforcement Training Standards Board. Provides that each law enforcement agency that uses police canines shall comply with the certification requirements within 12 months after the adoption of the requirements. Provides that the Board shall review statistical reports of the use of police canines for traffic stops. Amends the Department of State Police Law to provide that the Department of State Police shall provide administrative support to the Board. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Illinois Police Canine Certification Act.
 
6    Section 5. Illinois Police Canine Certification Board;
7members.
8    (a) The Illinois Police Canine Certification Board (Board)
9is hereby created. The Board shall consist of 11 members
10appointed as follows:
11        (1) two members appointed by the Illinois Chiefs of
12    Police Association, one of whom shall represent the Chicago
13    Police Department;
14        (2) two members appointed by the Illinois Sheriffs
15    Association, one of whom shall represent the Cook County
16    Sheriff's Department;
17        (3) two members appointed by the Department of State
18    Police;
19        (4) two members representing the canine industry who
20    shall be appointed by the Law Enforcement Training
21    Standards Board;
22        (5) two members appointed by the Illinois State Police
23    Academy Canine Training Section; and

1        (6) the Chairman of the Law Enforcement Training
2    Standards Board or his or her designee.
3    (b) All Board members, except for appointed
4representatives from the canine industry, shall be sworn
5officers from municipal, county, or State police departments.
6All Board members shall have completed a State-recognized
7police canine training course or shall be recognized by the
8State as a canine trainer. In addition, all Board members shall
9have trained at least 3 police canine dogs or shall have served
10as a judge on at least 5 separate occasions with either the
11United States Police Canine Association or the North American
12Police Work Dog Association.
13    (c) Board members shall serve without compensation, but may
14be reimbursed for their actual and necessary expenses.
15    (d) The Chairman of the Board shall be appointed from among
16its members.
17    (e) The Department of State Police shall provide
18administrative support for the Board.
 
19    Section 10. Requirements for police canines.    Within 180
20days after its members are appointed and qualified, the
21Illinois Police Canine Certification Board shall, by
22administrative rule, establish requirements for the
23certification of all police canines that are used by law
24enforcement agencies within the State. The canine
25certification requirements shall be submitted to and adopted by

1the Law Enforcement Training Standards Board within 90 days
2after receipt. Each law enforcement agency that uses police
3canines shall comply with the requirements within 12 months
4after the adoption of the requirements.
 
5    Section 15. Police canine records, statistics, and
6reports.
7    (a) A law enforcement agency that uses a police canine
8shall keep a record of each traffic stop in which the police
9canine is used. The record shall include, but shall not be
10limited to, the following information:
11        (1) The location or address of the traffic stop.
12        (2) Whether the canine accurately indicated the
13    presence of a controlled substance or any other substance
14    or device the possession of which is unlawful or may be
15    used as evidence in a criminal proceeding.
16        (3) The race of the driver.
17    (b) The law enforcement agency shall compile a statistical
18report using the records described in subsection (a) and shall
19issue that report to the Police Canine Certification Board and
20the Racial Profiling Prevention and Data Oversight Board for
21review.
 
22    Section 20. The Department of State Police Law of the Civil
23Administrative Code of Illinois is amended by adding Section
242605-595 as follows:

1    (20 ILCS 2605/2605-595 new)
2    Sec. 2605-595. Illinois Police Canine Certification Board.
3The Department shall provide administrative support to the
4Illinois Police Canine Certification Board.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.
