AMENDMENT TO HOUSE BILL 1138

AMENDMENT NO. ______. Amend House Bill 1138 by replacing everything after the enacting clause with the following:

"Section 5. The Department of Transportation Law of the Civil Administrative Code of Illinois is amended by adding Section 2705-505.7 as follows:

Sec. 2705-505.7. School zone speed limits; signs; notice. Before erecting any new signs regulating speed pursuant to Section 11-605 of the Illinois Vehicle Code or similar local ordinance, or changing the speed limit of a roadway within 2,000 feet of the primary entrance or entrances of a school or schools, the Department or body having jurisdiction over the roadway shall notify the principal of any schools within 2,000 feet of the proposed action and the chief of the local law enforcement agency. The notice shall contain (i) a description of the proposed action, including the proposed speed limit changes and geography involved; and (ii) a contact person to whom comments may be submitted.

The Department or body having jurisdiction over the roadway shall provide at least 30 days notice of the proposed action and shall accept comments from any interested party for at least 30 days. The notice shall be in the form of a letter delivered by first class mail and may also be provided through other means. Upon request of a school district, any notice required by this Section shall be delivered to a designated contact at the district instead of to individual principals. Nothing in this Section shall prohibit forms of public notice, public comment, or public hearings in addition to those required by this Section.

This Section shall not apply in municipalities with a population over 1,000,000 persons.

Section 99. Effective date. This Act takes effect upon becoming law.".
