AMENDMENT TO HOUSE BILL 700

2    AMENDMENT NO. ______. Amend House Bill 700, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Administrative Procedure Act is
6amended by changing Section 10-65 as follows:
 
7    (5 ILCS 100/10-65)  (from Ch. 127, par. 1010-65)
8    Sec. 10-65. Licenses.
9    (a) When any licensing is required by law to be preceded by
10notice and an opportunity for a hearing, the provisions of this
11Act concerning contested cases shall apply.
12    (b) When a licensee has made timely and sufficient
13application for the renewal of a license or a new license with
14reference to any activity of a continuing nature, the existing
15license shall continue in full force and effect until the final
16agency decision on the application has been made unless a later

1date is fixed by order of a reviewing court.
2    (c) An application for Except as provided in Section 1-17
3of the Department of Natural Resources Act, an application for
4the renewal of a license or a new license shall include the
5applicant's social security number, which shall be retained in
6the agency's records pertaining to the license. As soon as
7practical, an agency must assign a customer identification
8number to each applicant for a license that the applicant may
9use in place of his or her social security number on the
10application for a license or renewal of a license. A licensee's
11social security number shall not appear on the face of his or
12her license. Each agency shall require the licensee to certify
13on the application form, under penalty of perjury, that he or
14she is not more than 30 days delinquent in complying with a
15child support order. Every application shall state that failure
16to so certify shall result in disciplinary action, and that
17making a false statement may subject the licensee to contempt
18of court. The agency shall notify each applicant or licensee
19who acknowledges a delinquency or who, contrary to his or her
20certification, is found to be delinquent or who after receiving
21notice, fails to comply with a subpoena or warrant relating to
22a paternity or a child support proceeding, that the agency
23intends to take disciplinary action. Accordingly, the agency
24shall provide written notice of the facts or conduct upon which
25the agency will rely to support its proposed action and the
26applicant or licensee shall be given an opportunity for a

1hearing in accordance with the provisions of the Act concerning
2contested cases. Any delinquency in complying with a child
3support order can be remedied by arranging for payment of past
4due and current support. Any failure to comply with a subpoena
5or warrant relating to a paternity or child support proceeding
6can be remedied by complying with the subpoena or warrant. Upon
7a final finding of delinquency or failure to comply with a
8subpoena or warrant, the agency shall suspend, revoke, or
9refuse to issue or renew the license. In cases in which the
10Department of Healthcare and Family Services (formerly
11Department of Public Aid) has previously determined that an
12applicant or a licensee is more than 30 days delinquent in the
13payment of child support and has subsequently certified the
14delinquency to the licensing agency, and in cases in which a
15court has previously determined that an applicant or licensee
16has been in violation of the Non-Support Punishment Act for
17more than 60 days, the licensing agency shall refuse to issue
18or renew or shall revoke or suspend that person's license based
19solely upon the certification of delinquency made by the
20Department of Healthcare and Family Services (formerly
21Department of Public Aid) or the certification of violation
22made by the court. Further process, hearings, or
23redetermination of the delinquency or violation by the
24licensing agency shall not be required. The licensing agency
25may issue or renew a license if the licensee has arranged for
26payment of past and current child support obligations in a

1manner satisfactory to the Department of Healthcare and Family
2Services (formerly Department of Public Aid) or the court. The
3licensing agency may impose conditions, restrictions, or
4disciplinary action upon that license.
5    (d) Except as provided in subsection (c), no agency shall
6revoke, suspend, annul, withdraw, amend materially, or refuse
7to renew any valid license without first giving written notice
8to the licensee of the facts or conduct upon which the agency
9will rely to support its proposed action and an opportunity for
10a hearing in accordance with the provisions of this Act
11concerning contested cases. At the hearing, the licensee shall
12have the right to show compliance with all lawful requirements
13for the retention, continuation, or renewal of the license. If,
14however, the agency finds that the public interest, safety, or
15welfare imperatively requires emergency action, and if the
16agency incorporates a finding to that effect in its order,
17summary suspension of a license may be ordered pending
18proceedings for revocation or other action. Those proceedings
19shall be promptly instituted and determined.
20    (e) Any application for renewal of a license that contains
21required and relevant information, data, material, or
22circumstances that were not contained in an application for the
23existing license shall be subject to the provisions of
24subsection (a).

11    Section 125. The Illinois Explosives Act is amended by
12changing Section 2002 as follows:

14    Sec. 2002. Original individual license; Application; Fees.
15Applications by individuals for original licenses shall be made
16to the Department, in writing, on forms prescribed by the
17Department. The application shall be accompanied by the
18required fee, which is not refundable. All license application
19fees collected under this provision of this Act shall be
20deposited into the Explosives Regulatory Fund. The application
21shall require such information as in the judgment of the
22Department will enable the Department to pass on the
23qualifications of the applicant for a license. It shall
24include, but need not be limited to, information concerning

1age, full name of applicant, present residence, date of birth,
2sex, physical description, social security number or drivers
3license number, and the purpose for which and the place or
4places where the explosive materials are to be used or
5possessed. Each applicant shall file, with his application,
6fingerprint based data, or other state of the art criminal
7identification data, in the form and manner required by the
8Illinois State Police to enable the Illinois State Police to
9conduct criminal history checks on the applicant.

2    (a) No person shall operate a pre-license school or school
3branch without possessing a valid pre-license school or school
4branch license issued by the Department. No person shall act as
5a pre-license instructor at a pre-license school or school
6branch without possessing a valid pre-license instructor
7license issued by the Department. Every person who desires to
8obtain a pre-license school, school branch, or pre-license
9instructor license shall make application to the Department in
10writing in form and substance satisfactory to the Department
11and pay the required fees prescribed by rule. In addition to
12any other information required to be contained in the
13application, every application for an original or renewed
14license shall include the applicant's Social Security number,
15which shall be retained in the agency's records pertaining to
16the license. As soon as practical, the Department shall assign
17a customer's identification number to each applicant for a
18license.
19    Every application for a renewal or restored license shall
20require the applicant's customer identification number.
21    The Department shall issue a pre-license school, school
22branch, or pre-license instructor license to applicants who
23meet qualification criteria established by rule. The
24Department may refuse to issue, suspend, revoke, or otherwise
25discipline a pre-license school, school branch, or pre-license
26instructor license or may withdraw approval of a course offered

1by a pre-license school for good cause. Disciplinary
2proceedings shall be conducted by the Board in the same manner
3as other disciplinary proceedings under this Act.
4    (b) All pre-license instructors must teach at least one
5course within the period of licensure or take an instructor
6training program approved by the Department in lieu thereof. A
7pre-license instructor may teach at more than one licensed
8pre-license school.
9    (c) The term of license for pre-license schools, branches,
10and instructors shall be 2 years as established by rule.
11    (d) The Department or the Advisory Council may, after
12notice, cause a pre-license school to attend an informal
13conference before the Advisory Council for failure to comply
14with any requirement for licensure or for failure to comply
15with any provision of this Act or the rules for the
16administration of this Act. The Advisory Council shall make a
17recommendation to the Board as a result of its findings at the
18conclusion of any such informal conference.
19    (e) For purposes of this Section, the term "pre-license"
20shall also include the 30-hour post-license course required to
21be taken to retain a broker's license.

25    Sec. 30-25. Licensing of continuing education instructors.

1    (a) No such person shall act as a continuing education
2instructor at a continuing education school or branch without
3possessing a valid continuing education instructor license and
4satisfying any other qualification criteria established by the
5Department by rule.
6    (b) After the effective date of this Act, every person who
7desires to obtain a continuing education instructor's license
8shall attend and successfully complete a one-day instructor
9development workshop, as approved by the Department. The term
10of licensure for a continuing education instructor shall be 2
11years and as established by rule. Every person who desires to
12obtain a continuing education instructor license shall make
13application to the Department in writing on forms prescribed by
14the Office, accompanied by the fee prescribed by rule. In
15addition to any other information required to be contained in
16the application, every application for an original or renewed
17license shall include the applicant's Social Security number,
18which shall be retained in the agency's records pertaining to
19the license. As soon as practical, the Department shall assign
20a customer's identification number to each applicant for a
21license.
22    Every application for a renewal or restored license shall
23require the applicant's customer identification number.
24    The Department shall issue a continuing education
25instructor license to applicants who meet qualification
26criteria established by this Act or rule.
