AMENDMENT TO HOUSE BILL 440

2    AMENDMENT NO. ______. Amend House Bill 440 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Latino Family Commission Act is
5amended by adding Section 35 as follows:
 
6    (20 ILCS 3983/35 new)
7    Sec. 35. The Secure Communities Action Task Force;
8suspension of Secure Communities Memorandum of Agreement.
9    (a) The Secure Communities Memorandum of Agreement between
10the State and the federal Immigration and Customs Enforcement
11Agency is aimed at removing undocumented individuals who have
12committed serious criminal offenses. Current data suggests
13that between 44% and 78% of undocumented individuals detained
14by law enforcement in Illinois were not detained on criminal
15charges; the national average is 27%. This disparity suggests
16that current implementation efforts are not aligned with the

1purpose of the program and result in an unnecessary burden to
2jails and local taxpayers and decreased security statewide.
3Therefore, the Secure Communities Memorandum of Agreement is
4hereby suspended until a study is conducted by the Secure
5Communities Action Task Force created in subsection (b) of this
6Section.
7    (b) The Secure Communities Action Task Force is hereby
8created. The Task Force shall consist of 9 members appointed as
9follows: 2 members appointed by the Senate President; 2 members
10appointed by the Senate Minority Leader; 2 members appointed by
11the Speaker of the House of Representatives; 2 members
12appointed by the House Minority Leader; one member, to serve as
13chair, appointed by the Governor. Membership of the Secure
14Communities Action Task Force shall be representative of law
15enforcement, affected communities, and immigration and human
16rights advocacy groups. Members shall serve without
17compensation, but may be reimbursed for expenses associated
18with the Secure Communities Task Force. The Secure Communities
19Task Force may accept donated services and other resources that
20may be necessary to complete the work of the Task Force from
21not-for-profit organizations. The Department of Human Rights
22shall provide administrative and other support to the Task
23Force. The Secure Communities Action Task Force shall begin to
24conduct business upon the appointment of all members. The
25Secure Communities Action Task Force shall review data and
26conduct additional investigations concerning the Secure

1Communities Memorandum of Agreement, including hearings in
2participating counties, and shall report its findings and
3recommendations to the Governor and the General Assembly no
4later than June 30, 2012. The Task Force is dissolved upon
5submission of the report.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.".
