AMENDMENT TO SENATE BILL 2632

2     AMENDMENT NO. ______. Amend Senate Bill 2632 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Public Land Pack and Saddle Animal Access Act.
 
6     Section 5. Access to State parks. In maintaining the State
7 parks, the Department of Natural Resources shall preserve and
8 facilitate the continued use and access by pack and saddle
9 animals at State parks where the use of pack and saddle animals
10 is authorized by the Department. The Department of Natural
11 Resources shall also ensure that its State park land management
12 policies shall not arbitrarily or capriciously discriminate
13 against equine travel within State parks. Except as provided in
14 Section 10 of this Act, State parks designated for the use of
15 pack and saddle animals shall remain open and accessible for
16 such use.

1     Section 10. Trail closure.
2     (a) The Department of Natural Resources may implement a
3 reduction in access to a trail or road by pack and saddle
4 animals at State Parks under the following conditions:
5         (1) where conditions are not suitable because of
6     significant public safety concerns or necessary
7     maintenance; or
8         (2) for reasons related to the mission of the
9     Department of Natural Resources.
10     (b) If a trail closure or other reduction in trail access
11 is implemented under this Section, a written notice must be
12 posted at the trailhead stating the cause and the estimated
13 duration of the reduced access.
14     (c) Nothing in this Section alters or limits the authority
15 of the Department of Natural Resources to implement a temporary
16 emergency closure of a trail or road to pack and saddle
17 animals.".
