AMENDMENT TO HOUSE BILL 5917

2     AMENDMENT NO. ______. Amend House Bill 5917 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Food Handling Regulation Enforcement Act is
5 amended by changing Section 3 as follows:
 
6     (410 ILCS 625/3)  (from Ch. 56 1/2, par. 333)
7     Sec. 3. Food service sanitation manager.
8     (a) Each food service establishment shall be under the
9 operational supervision of a certified food service sanitation
10 manager in accordance with rules promulgated under this Act.
11     (b) By July 1, 1990, the Director of the Department of
12 Public Health in accordance with this Act, shall promulgate
13 rules for the education, examination, and certification of food
14 service establishment managers and instructors of the food
15 service sanitation manager certification education programs. A

1 sanitation manager instructor certificate shall be valid for 5
2 years, unless revoked by the Department of Public Health, and
3 shall not be transferable from the individual to whom it was
4 issued. Recertification shall be accomplished by presenting
5 evidence of ongoing food safety and food sanitation education
6 or re-examination, in compliance with rules promulgated by the
7 Director. Existing certificates shall expire on the printed
8 expiration date or 5 years from the effective date of this
9 amendatory Act of 1989.
10     Any individual may elect to take the Department of Public
11 Health food service sanitation manager certification
12 examination or take an accredited certification examination
13 administered by a testing authority previously approved by the
14 Department. The Department shall charge a fee of $35 for each
15 new and renewed food service sanitation manager certificate and
16 $10 for each replacement certificate. All fees collected under
17 this Section shall be deposited into the Food and Drug Safety
18 Fund.
19     Any fee received by the Department under this Section that
20 is submitted for the renewal of an expired food service
21 sanitation manager certificate may be returned by the Director
22 after recording the receipt of the fee and the reason for its
23 return.
24     (c) Beginning July 1, 2011, any individual seeking initial
25 certification shall be required to complete a minimum of 7
26 hours of certification training approved by the Department and

1 successfully pass a certification examination pursuant to
2 subsection (b) of this Section.
3     (d) Beginning July 1, 2011, any individual who has a
4 current valid food service sanitation manager certification
5 from another state where that state required the individual to
6 successfully pass a food service sanitation manager accredited
7 certification examination in order to obtain the certification
8 shall be issued an Illinois food service sanitation manager
9 certification upon proof of residency in the state where
10 certification was issued, application, and payment of the fee
11 established in subsection (b) of this Section.
12     (e) For the purposes of this Section:
13         "Accredited certification examination" means a food
14     protection certification examination that meets the
15     criteria established by the Conference for Food
16     Protection, or its successor, as determined by an
17     accrediting organization.
18         "Accrediting organization" means an independent
19     organization, such as the American National Standards
20     Institute, that determines whether a food protection
21     certification examination meets the standards established
22     by the Conference for Food Protection or its successor.
