Amends the Illinois Vehicle Code. Provides that it is either an offense against the regulations governing the movement of vehicles or a Class A misdemeanor, depending on which provision applicable, for a person to accompany or provide instruction to a driver who is a minor and driving a motor vehicle pursuant to an instruction permit, while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof.

| AN ACT concerning transportation.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Vehicle Code is amended by adding | 5 |
| Section 11-507 as follows: | 6 |
| (625 ILCS 5/11-507 new) | 7 |
| Sec. 11-507. Supervising a minor driver while under the | 8 |
| influence of alcohol, other drug or drugs, intoxicating | 9 |
| compound or compounds or any combination thereof. | 10 |
| (a) A person shall not accompany or provide instruction, | 11 |
| pursuant to paragraph (1) of subsection (a) of Section 6-107.1 | 12 |
| of this Code, to a driver who is a minor and driving a motor | 13 |
| vehicle pursuant to an instruction permit under Section 6-107.1 | 14 |
| of this Code, while: | 15 |
| (1) the alcohol concentration in the person's blood
or | 16 |
| breath is 0.08 or more based on the definition of blood and | 17 |
| breath units in Section 11-501.2 of this Code; | 18 |
| (2) under the influence of alcohol; | 19 |
| (3) under the influence of any intoxicating compound
or | 20 |
| combination of intoxicating compounds to a degree that | 21 |
| renders the person incapable of properly supervising or | 22 |
| providing instruction to the minor driver; | 23 |
| (4) under the influence of any other drug or

| combination of drugs to a degree that renders the person | 2 |
| incapable of properly supervising or providing instruction | 3 |
| to the minor driver; | 4 |
| (5) under the combined influence of alcohol, other
drug | 5 |
| or drugs, or intoxicating compound or compounds to a degree | 6 |
| that renders the person incapable of properly supervising | 7 |
| or providing instruction to the minor driver; or | 8 |
| (6) there is any amount of a drug, substance, or
| 9 |
| compound in the person's breath, blood, or urine resulting | 10 |
| from the unlawful use or consumption of cannabis listed in | 11 |
| the Cannabis Control Act, a controlled substance listed in | 12 |
| the Illinois Controlled Substances Act, an intoxicating | 13 |
| compound listed in the Use of Intoxicating Compounds Act, | 14 |
| or methamphetamine as listed in the Methamphetamine | 15 |
| Control and Community Protection Act. | 16 |
| (b) A person found guilty of violating paragraphs (1), (2), | 17 |
| or (3) of subsection (a) of this Section is guilty of an | 18 |
| offense against the regulations governing the movement of | 19 |
| vehicles. | 20 |
| (c) A person found guilty of violating paragraphs (4), (5), | 21 |
| or (6) of subsection (a) of this Section is guilty of a Class A | 22 |
| misdemeanor.
