AMENDMENT TO HOUSE BILL 4623

2     AMENDMENT NO. ______. Amend House Bill 4623, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Downstate Public Transportation Act is
6 amended by changing Section 2-15.2 as follows:
 
7     (30 ILCS 740/2-15.2)
8     Sec. 2-15.2. Free services; eligibility.
9     (a) Notwithstanding any law to the contrary, no later than
10 60 days following the effective date of this amendatory Act of
11 the 95th General Assembly and until subsection (b) is
12 implemented and then beginning again when subsection (b)
13 becomes inoperative, any fixed route public transportation
14 services provided by, or under grant or purchase of service
15 contracts of, every participant, as defined in Section 2-2.02
16 (1)(a), shall be provided without charge to all senior citizen

1 residents of the participant aged 65 and older, under such
2 conditions as shall be prescribed by the participant.
3     (b) Notwithstanding any law to the contrary, no later than
4 180 days following the effective date of this amendatory Act of
5 the 96th General Assembly, any fixed route public
6 transportation services provided by, or under grant or purchase
7 of service contracts of, every participant, as defined in
8 Section 2-2.02 (1)(a), shall be provided without charge to
9 senior citizens aged 65 and older who have an annual household
10 income that does not exceed for households of one person 150%,
11 for households of 2 persons 150%, or for households with 3 or
12 more persons 125% of the income eligibility limitation set
13 forth in subsection (a-5) of Section 4 of the Senior Citizens
14 and Disabled Persons Property Tax Relief and Pharmaceutical
15 Assistance Act, under such conditions as shall be prescribed by
16 the participant. The Department on Aging shall furnish all
17 information reasonably necessary to determine eligibility,
18 including updated lists of individuals who are eligible for
19 services without charge under this Section. Nothing in this
20 Section shall relieve the participant from providing reduced
21 fares as may be required by federal law.
22     This subsection (b) becomes inoperative 2 years after the
23 effective date of this amendatory Act of the 96th General
24 Assembly.

1     Section 10. The Metropolitan Transit Authority Act is
2 amended by changing Section 51 as follows:
 
3     (70 ILCS 3605/51)
4     Sec. 51. Free services; eligibility.
5     (a) Notwithstanding any law to the contrary, no later than
6 60 days following the effective date of this amendatory Act of
7 the 95th General Assembly and until subsection (b) is
8 implemented and then beginning again when subsection (b)
9 becomes inoperative, any fixed route public transportation
10 services provided by, or under grant or purchase of service
11 contracts of, the Board shall be provided without charge to all
12 senior citizens of the Metropolitan Region (as such term is
13 defined in 70 ILCS 3615/1.03) aged 65 and older, under such
14 conditions as shall be prescribed by the Board.
15     (b) Notwithstanding any law to the contrary, no later than
16 180 days following the effective date of this amendatory Act of
17 the 96th General Assembly, any fixed route public
18 transportation services provided by, or under grant or purchase
19 of service contracts of, the Board shall be provided without
20 charge to senior citizens aged 65 and older who have an annual
21 household income that does not exceed for households of one
22 person 150%, for households of 2 persons 150%, or for
23 households with 3 or more persons 125% of the income
24 eligibility limitation set forth in subsection (a-5) of Section
25 4 of the Senior Citizens and Disabled Persons Property Tax

2 conditions as shall be prescribed by the Board. The Department

6 Section. Nothing in this Section shall relieve the Board from
7 providing reduced fares as may be required by federal law.
8     This subsection (b) becomes inoperative 2 years after the
9 effective date of this amendatory Act of the 96th General
10 Assembly.

12     Section 15. The Local Mass Transit District Act is amended
13 by changing Section 8.6 as follows:

15     Sec. 8.6. Free services; eligibility.
16     (a) Notwithstanding any law to the contrary, no later than
17 60 days following the effective date of this amendatory Act of
18 the 95th General Assembly and until subsection (b) is
19 implemented and then beginning again when subsection (b)
20 becomes inoperative, any fixed route public transportation
21 services provided by, or under grant or purchase of service
22 contracts of, every District shall be provided without charge
23 to all senior citizens of the District aged 65 and older, under
24 such conditions as shall be prescribed by the District.

1     (b) Notwithstanding any law to the contrary, no later than
2 180 days following the effective date of this amendatory Act of
3 the 96th General Assembly, any fixed route public

6 without charge to senior citizens aged 65 and older who have an
7 annual household income that does not exceed for households of
8 one person 150%, for households of 2 persons 150%, or for
9 households with 3 or more persons 125% of the income
10 eligibility limitation set forth in subsection (a-5) of Section
11 4 of the Senior Citizens and Disabled Persons Property Tax
12 Relief and Pharmaceutical Assistance Act, under such
13 conditions as shall be prescribed by the District. The
14 Department on Aging shall furnish all information reasonably
15 necessary to determine eligibility, including updated lists of
16 individuals who are eligible for services without charge under
17 this Section. Nothing in this Section shall relieve the
18 District from providing reduced fares as may be required by
19 federal law.

24     Section 20. The Regional Transportation Authority Act is
25 amended by changing Sections 3A.15 and 3B.14 as follows:

3     (a) Notwithstanding any law to the contrary, no later than
4 60 days following the effective date of this amendatory Act of
5 the 95th General Assembly and until subsection (b) is
6 implemented and then beginning again when subsection (b)
7 becomes inoperative, any fixed route public transportation
8 services provided by, or under grant or purchase of service
9 contracts of, the Suburban Bus Board shall be provided without
10 charge to all senior citizens of the Metropolitan Region aged
11 65 and older, under such conditions as shall be prescribed by
12 the Suburban Bus Board.
13     (b) Notwithstanding any law to the contrary, no later than
14 180 days following the effective date of this amendatory Act of
15 the 96th General Assembly, any fixed route public
16 transportation services provided by, or under grant or purchase
17 of service contracts of, the Suburban Bus Board shall be
18 provided without charge to senior citizens aged 65 and older
19 who have an annual household income that does not exceed for
20 households of one person 150%, for households of 2 persons
21 150%, or for households with 3 or more persons 125% of the
22 income eligibility limitation set forth in subsection (a-5) of
23 Section 4 of the Senior Citizens and Disabled Persons Property
24 Tax Relief and Pharmaceutical Assistance Act, under such
25 conditions as shall be prescribed by the Suburban Bus Board.

9 Assembly.

12     Sec. 3B.14. Free services; eligibility.
13     (a) Notwithstanding any law to the contrary, no later than
14 60 days following the effective date of this amendatory Act of
15 the 95th General Assembly and until subsection (b) is
16 implemented and then beginning again when subsection (b)
17 becomes inoperative, any fixed route public transportation
18 services provided by, or under grant or purchase of service
19 contracts of, the Commuter Rail Board shall be provided without
20 charge to all senior citizens of the Metropolitan Region aged
21 65 and older, under such conditions as shall be prescribed by
22 the Commuter Rail Board.
23     (b) Notwithstanding any law to the contrary, no later than
24 180 days following the effective date of this amendatory Act of
25 the 96th General Assembly, any fixed route public

1 transportation services provided by, or under grant or purchase
2 of service contracts of, the Commuter Rail Board shall be
3 provided without charge to senior citizens aged 65 and older
4 who have an annual household income that does not exceed for
5 households of one person 150%, for households of 2 persons
6 150%, or for households with 3 or more persons 125% of the
7 income eligibility limitation set forth in subsection (a-5) of
8 Section 4 of the Senior Citizens and Disabled Persons Property
9 Tax Relief and Pharmaceutical Assistance Act, under such
10 conditions as shall be prescribed by the Commuter Rail Board.
11 The Department on Aging shall furnish all information
12 reasonably necessary to determine eligibility, including
13 updated lists of individuals who are eligible for services
14 without charge under this Section. Nothing in this Section
15 shall relieve the Commuter Rail Board from providing reduced
16 fares as may be required by federal law.
