SYNOPSIS AS INTRODUCED:
 
410 ILCS 46/40 new

    Amends the Mercury-added Product Prohibition Act. Provides that, by January 1, 2010, the Agency shall adopt rules requiring each manufacturer of mercury-containing compact fluorescent lamps and mercury-containing compact fluorescent bulbs to display certain information on the packaging of those products. Requires the Agency to compile and publish on its website a report providing certain information about mercury-containing compact fluorescent lighting sold or distributed in the State. Requires the Agency, by January 1, 2010, to publish on its website information regarding the safe and proper disposal of mercury-containing compact fluorescent lighting. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mercury-added Product Prohibition Act is
5 amended by adding Section 40 as follows:
 
6     (410 ILCS 46/40 new)
7     Sec. 40. Mercury-containing compact fluorescent lighting;
8 labeling requirement; report.
9     (a) By January 1, 2010, the Agency shall adopt rules
10 requiring each manufacturer of mercury-containing compact
11 fluorescent lamps and mercury-containing compact fluorescent
12 bulbs to display prominently on the packaging of those products
13 a label describing the mercury content of the product as well
14 as directions for properly disposing of or recycling the
15 product.
16     (b) By January 1, 2010, the Agency shall compile and
17 publish on its website a report describing the mercury content,
18 toxicity, and energy efficiency of the various types of
19 mercury-containing compact fluorescent lamps and
20 mercury-containing compact fluorescent bulbs that are sold or
21 distributed within the State.
22     (c) By January 1, 2010, the Agency shall publish on its
23 website information regarding the safe and proper disposal of

1 mercury-containing compact fluorescent lamps and
2 mercury-containing compact fluorescent bulbs.
3     (d) Nothing in this Section shall be interpreted to
4 prohibit the manufacture, sale, or distribution of
5 mercury-containing compact fluorescent lighting within the
6 State.
 
7     Section 99. Effective date. This Act takes effect upon
8 becoming law.
