SYNOPSIS AS INTRODUCED:

770 ILCS 60/1.2 new

Amends the Mechanics Lien Act. Provides that a person who would be entitled to a lien for furnishing materials or equipment for the construction upon or improvement to real property shall be entitled to a lien for the rental of materials or equipment used in that construction or improvement. Effective immediately.

A BILL FOR

AN ACT concerning liens.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Mechanics Lien Act is amended by adding Section 1.2 as follows:

(770 ILCS 60/1.2 new)

Sec. 1.2. Rental material or equipment. Any person, whether contractor or subcontractor, who, under this Act, would be entitled to a lien for the furnishing of material or equipment consumed in the process of an improvement to or construction upon real estate shall be entitled to a lien for the rental of material or equipment for use in the process of an improvement to or construction upon real estate, to the same extent and in the same manner as provided in this Act for other liens, provided that the material or equipment is actually employed at the site of the construction or improvement.

Section 99. Effective date. This Act takes effect upon becoming law.
