AMENDMENT TO SENATE BILL 211

2     AMENDMENT NO. ______. Amend Senate Bill 211 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the Task
5 Forces on State Employed Nurses Act.
 
6     Section 5. Definitions. As used in this Act:
7     "Facility" means a correctional facility, youth
8 correctional facility, State-operated developmental center,
9 State-operated mental health facility or Illinois Veterans
10 Home.
11     "Nurse" means any advanced practice nurse or registered
12 professional nurse, as defined in the Nursing and Advanced
13 Practice Nursing Act, who receives an hourly wage and has
14 direct responsibility to carry out nursing care or related
15 duties.

1     Section 10. Facility Task Forces on State Employed Nurses.
2     (a) A Facility Task Force on State Employed Nurses is
3 created in each facility funded under the Department of
4 Corrections, the Department of Juvenile Justice, the
5 Department of Human Services, or the Department of Veterans'
6 Affairs. The purpose of each Facility Task Force is minimizing
7 mandatory overtime in Illinois' 24 hour direct care facilities.
8     (b) Each Facility Task Force shall consist of the following
9 members:
10         (1) Labor relations personnel or personnel staff, or
11     both, in the facility.
12         (2) Representatives of the Illinois Nurses Association
13     employed in the facility.
14         (3) Administrative staff of the facility.
15     (c) Each Facility Task Force shall meet quarterly to
16 discuss options to reduce the amount of overtime, as well as
17 nurse staffing levels, including but not limited to creating an
18 interagency pool of nurses with part-time and traveling
19 registered nurses with intent to hire as State employed nurses.
20     (d) Each Facility Task Force shall report its findings to
21 the agency under which the facility is funded within 30 days of
22 each Facility Task Force meeting.
23     (e) Each Facility Task Force shall have its first meeting
24 by July 1, 2007 or within 60 days after adjournment of the 2007
25 regular legislative session.

1     Section 15. State Task Force on State Employed Nurses.
2     (a) A State Task Force on State Employed Nurses is created
3 to address the issue of minimizing mandatory overtime in
4 Illinois' 24 hour direct care facilities. The State Task Force
5 shall review the reports received by each agency as a result of
6 the Facility Task Force meetings.
7     (b) The State Task Force shall consist of the following
8 members:
9         (1) Representatives of the Department of Corrections.
10         (2) Representatives of the Department of Juvenile
11     Justice.
12         (3) Representatives of the Department of Human
13     Services.
14         (4) Representatives of the Department of Veterans'
15     Affairs.
16         (5) Four legislative members, appointed one each by the
17     President of the Senate, the Minority Leader of the Senate,
18     the Speaker of the House of Representatives, and the
19     Minority Leader of the House of Representatives.
20         (6) At least one representative from the Governor's
21     staff.
22         (7) Representatives from the Illinois Nurses
23     Association.
24         (8) Representatives of the administrative staff from
25     within the facilities.
26     (c) The State Task Force shall convene meetings twice each

1 year.
2     (d) A report shall be submitted to the General Assembly by
3 January 1, 2008, for the review and consideration of the
4 members.
 
5     Section 99. Effective date. This Act takes effect upon
6 becoming law.".
