1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Power Agency Act is amended by
5 adding Section 1-128 as follows:
 
6     (20 ILCS 3855/1-128 new)
7     Sec. 1-128. Renewable energy program. The Agency shall, in
8 conjunction with the Department of Commerce and Economic
9 Opportunity, develop a program to promote renewable energy and
10 net-metering options in the State.
11     Notwithstanding any other rulemaking authority that may
12 exist, neither the Governor nor any agency or agency head under
13 the jurisdiction of the Governor has any authority to make or
14 promulgate rules to implement or enforce the provisions of this
15 Section. If, however, the Governor believes that rules are
16 necessary to implement or enforce the provisions of this
17 Section, the Governor may suggest rules to the General Assembly
18 by filing them with the Clerk of the House and the Secretary of
19 the Senate and by requesting that the General Assembly
20 authorize such rulemaking by law, enact those suggested rules
21 into law, or take any other appropriate action in the General
22 Assembly's discretion. Nothing contained in this Section shall
23 be interpreted to grant rulemaking authority under any other

1 Illinois statute where such authority is not otherwise
2 explicitly given. For the purposes of this paragraph, "rules"
3 is given the meaning contained in Section 1-70 of the Illinois
4 Administrative Procedure Act, and "agency" and "agency head"
5 are given the meanings contained in Sections 1-20 and 1-25 of
6 the Illinois Administrative Procedure Act to the extent that
7 such definitions apply to agencies or agency heads under the
8 jurisdiction of the Governor.
