AMENDMENT TO HOUSE BILL 4645

2     AMENDMENT NO. ______. Amend House Bill 4645, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Illinois Finance Authority Act is amended
6 by adding Section 825-81 as follows:
 
7     (20 ILCS 3501/825-81 new)
8     Sec. 825-81. Fire station revolving loan program.
9     (a) The Authority and the State Fire Marshal may jointly
10 administer a fire station revolving loan program. The program
11 may provide zero-interest loans for the construction,
12 rehabilitation, remodeling, or expansion of a fire station or
13 the acquisition of land for the construction or expansion of a
14 fire station by a fire department, a fire protection district,
15 or a township fire department. Once the program receives
16 funding, the Authority shall make loans based on need, as

1 determined by the State Fire Marshal.
2     (b) The loan funds, subject to appropriation, may be paid
3 out of the Fire Station Revolving Loan Fund, a special fund in
4 the State treasury. The Fund may consist of any moneys
5 transferred or appropriated into the Fund, as well as all
6 repayments of loans made under the program. Once the program
7 receives funding, the Fund may be used for loans to fire
8 departments and fire protection districts to construct,
9 rehabilitate, remodel, or expand fire stations or acquire land
10 for the construction or expansion of fire stations and for no
11 other purpose. All interest earned on moneys in the Fund shall
12 be deposited into the Fund.
13     (c) A loan under the program may not exceed $2,000,000 to
14 any fire department or fire protection district. The repayment
15 period for the loan may not exceed 20 years. The fire
16 department or fire protection district shall repay each year at
17 least 5% of the principal amount borrowed or the remaining
18 balance of the loan, whichever is less. All repayments of loans
19 shall be deposited into the Fire Station Revolving Loan Fund.
20     (d) Notwithstanding any other rulemaking authority that
21 may exist, neither the Governor nor any agency or agency head
22 under the jurisdiction of the Governor has any authority to
23 make or promulgate rules to implement or enforce the provisions
24 of this amendatory Act of the 95th General Assembly. If,
25 however, the Governor believes that rules are necessary to
26 implement or enforce the provisions of this amendatory Act of

1 the 95th General Assembly, the Governor may suggest rules to
2 the General Assembly by filing them with the Clerk of the House
3 and the Secretary of the Senate and by requesting that the
4 General Assembly authorize such rulemaking by law, enact those
5 suggested rules into law, or take any other appropriate action
6 in the General Assembly's discretion. Nothing contained in this
7 amendatory Act of the 95th General Assembly shall be
8 interpreted to grant rulemaking authority under any other
9 Illinois statute where such authority is not otherwise
10 explicitly given. For the purposes of this subsection, "rules"
11 is given the meaning contained in Section 1-70 of the Illinois
12 Administrative Procedure Act, and "agency" and "agency head"
13 are given the meanings contained in Sections 1-20 and 1-25 of
14 the Illinois Administrative Procedure Act to the extent that
15 such definitions apply to agencies or agency heads under the
16 jurisdiction of the Governor.
 
17     Section 10. The State Finance Act is amended by adding
18 Section 5.708 as follows:
 
19     (30 ILCS 105/5.708 new)
20     Sec. 5.708. The Fire Station Revolving Loan Fund.
 
21     Section 99. Effective date. This Act takes effect July 1,
22 2008.".
