1 AMENDMENT TO HOUSE BILL 3441
2 AMENDMENT NO. ______. Amend House Bill 3441 on page 1, by
3 replacing lines 11 through 14 with the following:

4 "State. On and after the effective date of this amendatory Act
5 of the 95th General Assembly, a municipality may exercise
6 zoning power or otherwise restrict the use of the above waters
7 only if (i) a majority of the shoreline is within the corporate
8 limits of the municipality, or (ii) the portion of the
9 shoreline within the corporate limits of the municipality plus
10 the portion of the shoreline outside of the corporate limits of
11 the municipality but controlled by property owners who consent
12 to the restriction accounts for a majority of the shoreline.".
