SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-20.40 new
105 ILCS 5/34-18.34 new

    Amends the School Code. Provides that a school board shall require that schools provide recess for all students in kindergarten through grade 6. Provides that recess must be at least 10 minutes in length and must occur once in the middle of each morning and once in the middle of each afternoon during which school is in session. Provides that if the principal determines that the weather is inclement, the principal shall direct that a recess be held indoors. Requires the principal to ensure that students are given the opportunity to engage in physical exercise during each recess. Provides that the time required for recesses is included in the minimum number of hours necessary to constitute a full day of attendance under the State aid formula provisions.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 10-20.40 and 34-18.34 as follows:
 
6     (105 ILCS 5/10-20.40 new)
7     Sec. 10-20.40. Recess required in elementary school. A
8 school board shall require that schools provide recess for all
9 students in kindergarten through grade 6. A recess must be at
10 least 10 minutes in length and must occur once in the middle of
11 each morning and once in the middle of each afternoon during
12 which school is in session. If the principal determines that
13 the weather is inclement, the principal shall direct that a
14 recess be held indoors. The principal shall ensure that
15 students are given the opportunity to engage in physical
16 exercise during each recess. The time required for recesses by
17 this Section is included in the minimum number of hours
18 necessary to constitute a full day of attendance under Section
19 18-8.05 of this Code.
