1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Illinois State Diabetes Commission Act.
 
6     Section 5. Illinois State Diabetes Commission. There is
7 hereby established within the Department of Human Services the
8 Illinois State Diabetes Commission. The Commission shall
9 consist of members that are residents of this State and shall
10 include an Executive Committee appointed by the Secretary of
11 Human Services as provided by rule. The members of the
12 Commission shall be appointed by the Secretary of Human
13 Services as follows:
14         (1) The Secretary of Human Services or the Secretary's
15     designee, who shall serve as chairperson of the Commission.
16         (2) Physicians who are board certified in
17     endocrinology, with at least one physician with expertise
18     and experience in the treatment of childhood diabetes and
19     at least one physician with expertise and experience in the
20     treatment of adult onset diabetes.
21         (3) Health care professionals with expertise and
22     experience in the prevention, treatment, and control of
23     diabetes.
24         (4) Representatives of the American Diabetes
25     Association and Juvenile Diabetes Research Foundation.
26         (5) Representatives of voluntary health organizations
27     or advocacy groups with an interest in the prevention,
28     treatment, and control of diabetes.
29         (6) Members of the public who have been diagnosed with
30     diabetes.
31     The Secretary of Human Services may appoint additional
32 members deemed necessary and appropriate by the Secretary.

1     Section 10. Members; meetings. Members of the Commission
2 shall be appointed by December 1, 2006. A member shall continue
3 to serve until his or her successor is duly appointed and
4 qualified.
5     Meetings shall be held 3 times per year or at the call of
6 the Commission chairperson.
 
7     Section 15. Reimbursement. Members shall serve without
8 compensation but shall, subject to appropriation, be
9 reimbursed for reasonable and necessary expenses actually
10 incurred in the performance of the member's official duties.
 
11     Section 20. Department support of Commission. The
12 Department of Human Services shall provide administrative
13 support and current staff as necessary for the effective
14 operation of the Commission.
 
15     Section 25. Duties. The Commission shall perform all of the
16 following duties:
17         (1) Hold public hearings to gather information from the
18     general public on issues pertaining to the prevention,
19     treatment, and control of diabetes.
20         (2) Develop a strategy for the prevention, treatment,
21     and control of diabetes in this State.
22         (3) Examine the needs of adults, children, racial and
23     ethnic minorities, and medically underserved populations
24     who have diabetes.
25         (4) Prepare and make available an annual report on the
26     activities of the Commission to the Secretary of Human
27     Services, the Speaker of the House of Representatives, the
28     Minority Leader of the House of Representatives, the
29     President of the Senate, the Minority Leader of the Senate,
30     and the Governor by June 30 of each year, beginning on June
31     30, 2007.

1     Section 30. Funding. The Department of Human Services may
2 accept on behalf of the Commission any federal funds or gifts
3 and donations from individuals, private organizations, and
4 foundations and any other funds that may become available.
 
5     Section 35. Rules. The Secretary of Human Services may
6 adopt rules to implement and administer this Act.
 
7     Section 90. Repeal. This Act is repealed on January 1,
8 2010.
 
9     Section 99. Effective date. This Act takes effect November
10 1, 2006.
