SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/6-507   from Ch. 121, par. 6-507

    Amends the Illinois Highway Code. Provides that a portion (rather than one half) of the tax required by the Code to be levied on property in a municipality whose streets are maintained by the municipality may be paid over to the treasurer of the municipality, subject to execution of an intergovernmental agreement for the improvement of roads or streets lying within the boundaries of both the municipality and a township (rather than shall be paid to the treasurer, to be appropriated to the improvement of roads or streets, either in or outside the municipality, that are within the road district under the direction of the municipality's corporate authorities). Effective immediately.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Highway Code is amended by changing
5 Section 6-507 as follows:
 
6     (605 ILCS 5/6-507)  (from Ch. 121, par. 6-507)
7     Sec. 6-507. All items of tax levy of any district
8 authorized by Sections 6-501, 6-503 and 6-504 of this Code
9 shall be extended by the county clerk as one tax upon the
10 collector's book and, except as hereinafter provided in this
11 Section, shall be paid to the treasurer of the district by the
12 collector as fast as the same is collected, other than such
13 rate per cent as shall be allowed for collecting the same.
14     A portion of One half the tax required to be levied by
15 Section 6--501 of this Code, on the property lying within a
16 municipality in which the streets and alleys are under the care
17 of the municipality may shall be paid over to the treasurer of
18 the municipality, subject to the execution of an
19 intergovernmental agreement that will specify the expenditure
20 of the funds on projects for to be appropriated to the
21 improvement of roads or streets that lie within both the
22 municipal and township boundaries , either within or without
23 the municipality and within the road district under the
24 direction of the corporate authorities of the municipality.
25 However, when any of the tax is expended beyond the limits of
26 the municipality it shall be with the consent of the highway
27 commissioner of the road district.
28     If any municipality has not appropriated the taxes received
29 by it as aforesaid for the improvement of roads or streets
30 within one year from the date of the receipt thereof, then the
31 unappropriated portion of such taxes shall forthwith be paid by
32 the Treasurer of such municipality to the Treasurer of the road

2 expended for road purposes within such road district.
