SYNOPSIS AS INTRODUCED:

    Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Requires the Department of State Police to develop a statewide emergency alert system for missing endangered seniors, to develop a community outreach program to promote awareness among State citizens of senior endangerment prevention and response, and to appoint a Child and Senior Safety Coordinator (rather than a Child Safety Coordinator). Requires the Department to prepare a report containing certain information when it receives a notification of a missing endangered senior and to forward the report to certain other parties. Requires the Department to begin an investigation concerning the missing endangered senior no later than 24 hours after receiving notification of the missing endangered senior. Provides a definition of "missing endangered senior". Amends the Illinois Police Training Act to require the Illinois Law Enforcement Training Standards Board to provide a training program for law enforcement personnel of local governmental agencies in the statewide coordinated child abduction and missing endangered senior alert system (rather than the child abduction alert system). Effective January 1, 2006.

1     AN ACT concerning state government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2605-480 as follows:
 
7     (20 ILCS 2605/2605-480)
8     Sec. 2605-480. Statewide kidnapping alert and prevention
9 program; Child and Senior Safety Coordinator; reports of
10 missing endangered seniors.
11     (a) The Department of State Police shall develop a
12 coordinated program for a statewide emergency alert system when
13 a child is missing or kidnapped or a senior is missing and
14 endangered. The system shall include, but is not limited to,
15 the use in coordination with the Illinois Department of
16 Transportation, of electronic message signs on roads and
17 highways in the vicinity of a child abduction or the vicinity
18 where a missing endangered senior was last seen to immediately
19 provide critical information to the public.
20     (b) The Department of State Police shall establish an AMBER
21 Plan Task Force to monitor and review the implementation and
22 operation of the system developed under subsection (a),
23 including procedures, budgetary requirements, and response
24 protocols. The Task Force shall also develop additional network
25 resources for use in the system.
26     (c) The Department of State Police, in coordination with
27 the Illinois Emergency Management Agency, shall develop and
28 implement a community outreach program to promote awareness
29 among citizens of the State the State's parents and children of
30 child abduction and senior endangerment prevention and
31 response.
32     (d) The Department of State Police, in coordination with

1 the State Board of Education, shall develop child abduction
2 prevention instruction for inclusion in elementary and
3 secondary school curricula throughout the State. The
4 Department and State Board of Education shall encourage the
5 inclusion of the child abduction prevention instruction in
6 private elementary and secondary school curricula throughout
7 the State.
8     (e) The Department shall appoint a Child and Senior Safety
9 Coordinator to assist in the establishment of State standards
10 for child and senior safety from kidnap, and abduction, and
11 endangerment and to advocate for the achievement of those
12 standards. The Child and Senior Safety Coordinator shall have
13 the qualifications and experience that the Department shall
14 require by rule. The Child and Senior Safety Coordinator shall
15 receive no compensation but shall be reimbursed for his or her
16 expenses from the Department's operations budget. No funds
17 shall be appropriated solely for the expenses of the Child and
18 Senior Safety Coordinator. The Department shall provide
19 technical assistance for the Child and Senior Safety
20 Coordinator from its existing resources.
21     (f) If the Department of State Police receives a
22 notification concerning a missing endangered senior, it shall
23 prepare a report on the missing endangered senior. The report
24 must include all of the following:
25         (1) Relevant information obtained from the
26     notification concerning the missing endangered senior,
27     including all of the following:
28             (A) a physical description of the missing
29         endangered senior;
30             (B) the date, time, and place that the missing
31         endangered senior was last seen; and
32             (C) the missing endangered senior's address.
33         (2) Information gathered by a preliminary
34     investigation, if one was made.
35         (3) A statement by the law enforcement officer in
36     charge stating the officer's assessment of the case based

1     on the evidence and information received.
2     The Department of State Police shall prepare the report
3 required by this subsection (f) as soon as practicable, but not
4 later than 5 hours after the Department receives notification
5 of a missing endangered senior.
6     (g) Upon completion of the report required by subsection
7 (f) the Department of State Police shall immediately forward
8 the contents of the report to all of the following:
9         (1) all law enforcement agencies that have
10     jurisdiction in the location where the missing endangered
11     senior lives and all law enforcement agencies that have
12     jurisdiction in the location where the missing endangered
13     senior was last seen;
14         (2) all law enforcement agencies to which the person
15     who made the notification concerning the missing
16     endangered senior requests the report be sent, if the
17     Department determines that the request is reasonable in
18     light of the information received;
19         (3) all law enforcement agencies that request a copy of
20     the report; and
21         (4) the National Crime Information Center's Missing
22     Person File, if appropriate.
23     (h) The Department of State Police shall begin an
24 investigation concerning the missing endangered senior not
25 later than 24 hours after receiving notification of a missing
26 endangered senior.
27     (i) For the purposes of this Section, "missing endangered
28 senior" means an individual 65 years of age or older who is
29 reported missing to a law enforcement agency and is, or is
30 believed to be:
31         (1) a temporary or permanent resident of Illinois;
32         (2) at a location that cannot be determined by an
33     individual familiar with the missing individual; and
34         (3) incapable of returning to the individual's
35     residence without assistance.

2     Section 10. The Illinois Police Training Act is amended by
3 changing Section 10.10 as follows:
 
4     (50 ILCS 705/10.10)
5     Sec. 10.10. Training in child abduction and missing
6 endangered senior alert system. The Board shall conduct a
7 training program for law enforcement personnel of local
8 governmental agencies in the statewide coordinated child
9 abduction and missing endangered senior alert system developed
10 under Section 2605-480 of the Department of State Police Law of
11 the Civil Administrative Code of Illinois.

13     Section 99. Effective date. This Act takes effect January
14 1, 2006.
