AMENDMENT TO SENATE BILL 931

2     AMENDMENT NO. ______. Amend Senate Bill 931, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:

"ARTICLE 5. GENERAL PROVISIONS.

 
6     Section 5-5. Short title. This Act may be cited as the
7 Nurse Educator Assistance Act.
 
8     Section 5-10. Purpose. The purpose of this Act is to
9 attract capable and promising students to the nursing educator
10 profession, increase employment and retention of individuals
11 who are working towards or who have received a master's or
12 doctoral degree in nursing, and provide opportunities for
13 persons making mid-career decisions to enter the nurse educator
14 profession.
 
15     Section 5-15. Definitions. In this Act:
16     "Approved program of professional nursing education" and
17 "approved program of practical nursing education" mean
18 programs of professional or practical nursing, respectively,
19 approved by the Department of Financial and Professional
20 Regulation under the provisions of the Nursing and Advanced
21 Practice Nursing Act.
22     "Commission" means the Illinois Student Assistance

1 Commission.
 
2     Section 5-20. Rulemaking. The Commission shall adopt all
3 rules necessary for the administration of this Act.

ARTICLE 10. NURSE EDUCATOR LOAN REPAYMENT PROGRAM.

 
5     Section 10-5. Nurse Educator Loan Repayment Program. There
6 is created, beginning July 1, 2007, the Nurse Educator Loan
7 Repayment Program to be administered by the Illinois Student
8 Assistance Commission. The program shall provide assistance,
9 subject to appropriation, to eligible nurse educators.
 
10     Section 10-10. Award; maximum time period; maximum amount.
11 Subject to appropriation, the Commission shall award a grant to
12 each qualified applicant for a maximum of 4 years. The amount
13 of this grant shall not exceed $5,000 per year. The Commission
14 shall encourage the recipient of a grant awarded under the
15 program to use the grant award for payment of the recipient's
16 educational loan.
 
17     Section 10-15. Application. All applications for grant
18 assistance under the program shall be made to the Commission in
19 a form and manner prescribed by the Commission. Applicants
20 shall also submit any supporting documents deemed necessary by
21 the Commission at the time of application.
 
22     Section 10-20. Eligibility.
23     (a) The Commission shall, on an annual basis, receive and
24 consider applications for grant assistance under the program.
25 An applicant is eligible for a grant under the program if the
26 Commission finds that the applicant:
27         (1) is a United States citizen or permanent resident;
28         (2) is a resident of Illinois;

1         (3) has worked for at least 12 consecutive months as a
2     nurse educator in an approved program of professional or
3     practical nursing education in Illinois;
4         (4) is a borrower with an outstanding balance due on an
5     educational loan; and
6         (5) has not defaulted on an educational loan.
7     (b) Preference may be given to previous recipients of a
8 grant under the program, provided that the recipient continues
9 to meet the eligibility requirements set forth in this Section.
10     (c) A recipient of a grant under the program must fulfill a
11 separate 12-month period as a nurse educator in an approved
12 program of professional or practical nursing education in
13 Illinois for each grant that he or she is awarded.

ARTICLE 15. NURSE EDUCATOR SCHOLARSHIP PROGRAM.

 
15     Section 15-5. Nurse Educator Scholarship Program. There is
16 created, beginning July 1, 2006, the Nurse Educator Scholarship
17 Program to be administered by the Illinois Student Assistance
18 Commission. The program shall provide scholarship assistance
19 until July 1, 2010, subject to appropriation, to eligible
20 students for nursing-related graduate study.
 
21     Section 15-10. Scholarship award; maximum time period;
22 maximum amount.
23     (a) Subject to appropriation, the Commission shall award a
24 nurse educator scholarship to each qualified applicant in an
25 amount sufficient to pay the tuition and fees of the Illinois
26 institution of higher learning at which the recipient is
27 enrolled, up to the current maximum amount of tuition and fees
28 charged to students enrolled in an approved program of
29 professional or practical nursing education at a public
30 university.
31     (b) Scholarship recipients shall also receive a stipend,

1 the amount of which shall not exceed $10,000, to cover other
2 costs of attendance, including, but not limited to, living
3 expenses. Stipend amounts for recipients enrolled on less than
4 a full-time basis shall be prorated by credit hour.
5     (c) A recipient may receive scholarship assistance under
6 the program for the equivalent of 8 semesters or 16 quarters of
7 full-time enrollment.
8     (d) The total amount of scholarship assistance awarded by
9 the Commission under the program to an individual in any given
10 fiscal year, when added to other financial assistance awarded
11 to that individual for that year, may not exceed the cost of
12 attendance at the institution of higher learning at which the
13 student is enrolled.
 
14     Section 15-15. Application. All applications for a
15 scholarship under the program shall be made to the Commission
16 in a form and manner prescribed by the Commission. Applicants
17 shall also submit any supporting documents deemed necessary by
18 the Commission at the time of application.
 
19     Section 15-20. Eligibility.
20     (a) The Commission shall, on an annual basis until July 1,
21 2010, receive and consider applications for scholarship
22 assistance under the program. An applicant is eligible for a
23 scholarship under the program if the Commission finds that the
24 applicant:
25         (1) is a United States citizen or permanent resident;
26         (2) is a resident of Illinois;
27         (3) is enrolled or accepted for enrollment on at least
28     a half-time basis in an approved program of professional or
29     practical nursing education at the graduate level at an
30     Illinois institution of higher learning.
31     (b) Scholarship recipients shall be selected from among
32 eligible applicants based on a combination of academic

1 excellence and financial need, as determined by the Commission.
2     (c) Preference may be given to previous recipients of a
3 scholarship under the program, provided that the recipient
4 continues to meet the eligibility requirements set forth in
5 this Section and maintains satisfactory academic progress as
6 determined by the institution of higher education at which he
7 or she is enrolled.
8     (d) Prior to receiving scholarship assistance for an
9 academic year, each recipient of a scholarship awarded under
10 the program must sign an agreement pledging that, within the
11 one-year period following the termination of the academic
12 program for which the recipient was awarded a scholarship, the
13 recipient shall (i) begin working as an educator in an approved
14 program of professional nursing education or an approved
15 program of practical nursing education in Illinois for a period
16 of not less than 5 years and (ii) upon request of the
17 Commission, provide the Commission with evidence that he or she
18 is fulfilling or has fulfilled the terms of the work agreement
19 required under this subsection (d).
 
20     Section 15-25. Payment to institution. All scholarship
21 funds distributed under the program shall be paid to the
22 institution on behalf of the scholarship recipient.
 
23     Section 15-30. Repayment upon default; exception.
24     (a) If a recipient of a scholarship awarded under this
25 Section fails to fulfill the work agreement required under the
26 program, the Commission shall require the recipient to repay
27 the amount of the scholarship or scholarships received,
28 prorated according to the fraction of the work agreement not
29 completed, plus interest at a rate of 5% and, if applicable,
30 reasonable collection fees.
31     (b) Payments received by the Commission under this Section
32 shall be remitted to the State Comptroller for deposit into the

1 General Revenue Fund, except that that portion of a recipient's
2 repayment that equals the amount in expenses that the
3 Commission has reasonably incurred in attempting collection
4 from that recipient shall be remitted to the State Comptroller
5 for deposit into the Commission's Accounts Receivable Fund.
6     (c) A recipient of a scholarship awarded by the Commission
7 under the program shall not be in violation of the agreement
8 entered into pursuant to this Article if the recipient is (i)
9 serving as a member of the armed services of the United States,
10 (ii) temporarily totally disabled, as established by a sworn
11 affidavit of a qualified physician, (iii) seeking and unable to
12 find full-time employment as a nursing educator and is able to
13 provide evidence of that fact, or (iv) taking additional
14 courses, on at least a half-time basis, related to nursing
15 education. Any extension of the period during which the work
16 requirement must be fulfilled shall be subject to limitations
17 of duration established by the Commission.

ARTICLE 90. AMENDATORY PROVISIONS.

 
19     Section 90-2. The State Finance Act is amended by changing
20 and renumbering Section 5.570, as added by Public Act 92-589,
21 as follows:

23     Sec. 5.569 5.570. The National Guard and Naval Militia
24 Grant Fund.

26     Section 90-5. The Board of Higher Education Act is amended
27 by adding Sections 9.31 and 9.32 as follows:

29     Sec. 9.31. Competitive grants to nursing schools. In order

1 to increase the number of nurses graduating from Illinois
2 institutions of higher learning, the Board shall establish and
3 administer a competitive grant program for institutions of
4 higher learning that award degrees in nursing. The grants may
5 be awarded on the basis of performance criteria that shall
6 include, but not be limited to, degree production, student
7 retention, and passage rates on professional licensure
8 examinations.
9     The Board shall adopt those rules that are necessary for
10 the implementation and administration of the grants
11 established under this Section.
 
12     (110 ILCS 205/9.32 new)
13     Sec. 9.32. Nurse educator fellowship program. In order to
14 ensure the retention of well-qualified nursing faculty, the
15 Board shall establish and administer a nurse educator
16 fellowship program that supplements nursing faculty salaries
17 at institutions of higher learning that award degrees in
18 nursing. Fellowships awarded under the program may be awarded
19 on a competitive basis.
20     The Board shall adopt those rules that are necessary for
21 the implementation and administration of the fellowship
22 program established under this Section.
 
23     Section 90-8. The Higher Education Student Assistance Act
24 is amended by changing Section 45 and by adding Section 65.80
25 as follows:

27     Sec. 45. Illinois National Guard and Naval Militia grant
28 program.
29     (a) As used in this Section:
30     "State controlled university or community college" means
31 those institutions under the administration of the Chicago

1 State University Board of Trustees, the Eastern Illinois
2 University Board of Trustees, the Governors State University
3 Board of Trustees, the Illinois State University Board of
4 Trustees, the Northeastern Illinois University Board of
5 Trustees, the Northern Illinois University Board of Trustees,
6 the Western Illinois University Board of Trustees, Southern
7 Illinois University Board of Trustees, University of Illinois
8 Board of Trustees, or the Illinois Community College Board.
9     "Tuition and fees" shall not include expenses for any
10 sectarian or denominational instruction, the construction or
11 maintenance of sectarian or denominational facilities, or any
12 other sectarian or denominational purposes or activity.
13     "Fees" means matriculation, graduation, activity, term, or
14 incidental fees. Exemption shall not be granted from any other
15 fees, including book rental, service, laboratory, supply, and
16 union building fees, hospital and medical insurance fees, and
17 any fees established for the operation and maintenance of
18 buildings, the income of which is pledged to the payment of
19 interest and principal on bonds issued by the governing board
20 of any university or community college.
21     (b) Any person who has served at least one year in the
22 Illinois National Guard or the Illinois Naval Militia and who
23 possesses all necessary entrance requirements shall, upon
24 application and proper proof, be awarded a grant to the
25 State-controlled university or community college of his or her
26 choice, consisting of exemption from tuition and fees for not
27 more than the equivalent of 4 years of full-time enrollment,
28 including summer terms, in relation to his or her course of
29 study at that State controlled university or community college
30 while he or she is a member of the Illinois National Guard or
31 the Illinois Naval Militia. Except as otherwise provided in
32 this Section, if the recipient of any grant awarded under this
33 Section ceases to be a member of the Illinois National Guard or
34 the Illinois Naval Militia while enrolled in a course of study

1 under that grant, the grant shall be terminated as of the date
2 membership in the Illinois National Guard or the Illinois Naval
3 Militia ended, and the recipient shall be permitted to complete
4 the school term in which he or she is then enrolled only upon
5 payment of tuition and other fees allocable to the part of the
6 term then remaining. If the recipient of a grant awarded under
7 this Section ceases to be a member of the Illinois National
8 Guard or the Illinois Naval Militia while enrolled in a course
9 of study under that grant but (i) has served in the Illinois
10 National Guard or the Illinois Naval Militia for at least 5
11 years and (ii) has served a cumulative total of at least 6
12 months of active duty, then that recipient shall continue to be
13 eligible for a grant for one year after membership in the
14 Illinois National Guard or the Illinois Naval Militia ended,
15 provided that the recipient has not already received the
16 exemption from tuition and fees for the equivalent of 4 years
17 of full-time enrollment, including summer terms, under this
18 Section. If the recipient of the grant fails to complete his or
19 her military service obligations or requirements for
20 satisfactory participation, the Department of Military Affairs
21 shall require the recipient to repay the amount of the grant
22 received, prorated according to the fraction of the service
23 obligation not completed, and, if applicable, reasonable
24 collection fees. The Department of Military Affairs may adopt
25 rules relating to its collection activities for repayment of
26 the grant under this Section. Unsatisfactory participation
27 shall be defined by rules adopted by the Department of Military
28 Affairs. Repayments shall be deposited in the National Guard
29 and Naval Militia Grant Fund. The National Guard and Naval
30 Militia Grant Fund is created as a special fund in the State
31 treasury. All money in the National Guard and Naval Militia
32 Grant Fund shall be used, subject to appropriation, by the
33 Illinois Student Assistance Commission for the purposes of this
34 Section.

1     A grant awarded under this Section shall be considered an
2 entitlement which the State-controlled university or community
3 college in which the holder is enrolled shall honor without any
4 condition other than the holder's maintenance of minimum grade
5 levels and a satisfactory student loan repayment record
6 pursuant to subsection (c) of Section 20 of this Act.
7     (c) Subject to a separate appropriation for such purposes,
8 the Commission may reimburse the State-controlled university
9 or community college for grants authorized by this Section.

13     Sec. 65.80. Forensic science grant program.
14     (a) In order to encourage graduate students to enter the
15 field of forensic science and continue their careers as
16 forensic scientists with the Department of State Police in one
17 of the specialty areas of forensic sciences that is considered
18 a shortage specialty area, the Commission shall, subject to
19 appropriation, establish and administer a forensic science
20 grant program.
21     (b) A qualified applicant may receive a maximum grant
22 amount of $30,000 to cover those expenses related to the
23 forensic science program in which he or she is enrolled.
24     (c) The Commission shall, on an annual basis until July 1,
25 2010, receive and consider applications for grant assistance
26 under the program. An applicant is eligible for a grant under
27 the program if the Commission finds that the applicant:
28         (1) is a United States citizen or permanent resident;
29         (2) is a resident of Illinois or will be a resident of
30     Illinois upon completion of the forensic science program;
31         (3) is enrolled on a full-time basis in a minimum
32     one-year program that combines graduate education with
33     training in a specific forensic discipline in a manner

1     equivalent to the Department of State Police's new examiner
2     training so as to prepare him or her to do casework; and
3         (4) meets or will meet all of the evaluation criteria
4     required by the Department of State Police for employment.
5     (d) Prior to receiving grant assistance for an academic
6 year, each recipient shall be required by the Commission to
7 sign an agreement under which the recipient pledges to seek
8 employment as a forensic scientist with the Department of State
9 Police and, if such employment is obtained, to continue as an
10 employee of the Department of State Police for a minimum period
11 of 4 years. If a recipient of a grant under this Section fails
12 to fulfill the employment obligation, the Commission shall
13 require that the recipient repay the amount of the grant award,
14 prorated according to the fraction of the obligation not
15 completed, plus interest at a rate of 5% and, if applicable,
16 reasonable collection fees, as established by the Commission.
17     (e) A recipient of a grant award under this Section shall
18 not be in violation of the agreement entered into pursuant to
19 subsection (d) of this Section if the Department of State
20 Police is unable to offer employment to the recipient. The
21 Commission may adopt rules relating to other conditions under
22 which a recipient is not considered to be in violation of the
23 agreement entered into pursuant to subsection (d) of this
24 Section. Any extension of the period during which the
25 employment requirement under subsection (d) of this Section
26 must be fulfilled shall be subject to the limitations of
27 duration established by the Commission.
28     (f) The Commission and the Department of State Police shall
29 adopt all rules that are necessary for the implementation and
30 administration of this Section.
 
31     Section 90-10. The Nursing Education Scholarship Law is
32 amended by changing Section 5 as follows:

2     Sec. 5. Nursing education scholarships. Beginning with the
3 fall term of the 2004-2005 academic year, the Department, in
4 accordance with rules and regulations promulgated by it for
5 this program, shall provide scholarships to individuals
6 selected from among those applicants who qualify for
7 consideration by showing:
8         (1) that he or she has been a resident of this State
9     for at least one year prior to application, and is a
10     citizen or a lawful permanent resident alien of the United
11     States;
12         (2) that he or she is enrolled in or accepted for
13     admission to an associate degree in nursing program,
14     hospital-based diploma in nursing program, baccalaureate
15     degree in nursing program, graduate degree in nursing
16     program, or practical nursing program at an approved
17     institution; and
18         (3) that he or she agrees to meet the nursing
19     employment obligation.
20     If in any year the number of qualified applicants exceeds
21 the number of scholarships to be awarded, the Department shall,
22 in consultation with the Center for Nursing Advisory Board,
23 consider the following factors in granting give priority in
24 awarding scholarships:
25             (A) Financial To students in the greatest
26         financial need, as shown on a standardized financial
27         needs assessment form used by an approved institution,
28         of students who will pursue their education on a
29         full-time or close closest to full-time basis and who
30         already have a certificate in practical nursing, a
31         diploma in nursing, or an associate degree in nursing
32         and are pursuing a higher degree.
33             (B) A student's status as a To registered nurse who
34         is nurses pursuing a graduate degree in nursing to

1         pursue employment in an approved institution that
2         educates licensed practical nurses and that educates
3         registered nurses in undergraduate and graduate
4         nursing programs.
5             (C) A student's merit, as shown through his or her
6         grade point average, class rank, and other academic and
7         extracurricular activities. The Department may add to
8         and further define these merit criteria by rule.
9     Unless otherwise indicated, scholarships shall be awarded
10 to recipients at approved institutions for a period of up to 2
11 years if the recipient is enrolled in an associate degree in
12 nursing program, up to 3 years if the recipient is enrolled in
13 a hospital-based diploma in nursing program, up to 4 years if
14 the recipient is enrolled in a baccalaureate degree in nursing
15 program, up to 5 years if the recipient is enrolled in a
16 graduate degree in nursing program, and up to one year if the
17 recipient is enrolled in a certificate in practical nursing
18 program. At least 40% of the scholarships awarded shall be for
19 recipients who are pursuing baccalaureate degrees in nursing,
20 30% of the scholarships awarded shall be for recipients who are
21 pursuing associate degrees in nursing or a diploma in nursing,
22 10% of the scholarships awarded shall be for recipients who are
23 pursuing a certificate in practical nursing, and 20% of the
24 scholarships awarded shall be for recipients who are pursuing a
25 graduate degree in nursing.

27     Section 90-15. The Nursing and Advanced Practice Nursing
28 Act is amended by changing Section 10-10 and by adding Title 17
29 as follows:

32     Sec. 10-10. Department powers and duties.

1     (a) The Department shall exercise the powers and duties
2 prescribed by the Civil Administrative Code of Illinois for
3 administration of licensing acts and shall exercise other
4 powers and duties necessary for effectuating the purpose of
5 this Act. None of the functions, powers, or duties of the
6 Department with respect to licensure and examination shall be
7 exercised by the Department except upon review by the Board.
8 The Department shall adopt rules to implement, interpret, or
9 make specific the provisions and purposes of this Act; however
10 no such rules shall be adopted by the Department except upon
11 review by the Board.
12     (b) The Department shall:
13         (1) prepare and maintain a list of approved programs of
14     professional nursing education and programs of practical
15     nursing education in this State, whose graduates, if they
16     have the other necessary qualifications provided in this
17     Act, shall be eligible to apply for a license to practice
18     nursing in this State;
19         (2) promulgate rules defining what constitutes an
20     approved program of professional nursing education and
21     what constitutes an approved program of practical nursing
22     education; and
23         (3) adopt rules for examination of candidates for
24     licenses and for issuance of licenses authorizing
25     candidates upon passing an examination to practice under
26     this Act.
27     (c) The Department may act upon the recommendations of the
28 Center for Nursing Advisory Board.

TITLE 17. ILLINOIS CENTER FOR NURSING

3     Sec. 17-5. Definitions. In this Title:
4     "Board" means the Center for Nursing Advisory Board.
5     "Center" means the Illinois Center for Nursing.

7     (Section scheduled to be repealed on January 1, 2008)
8     Sec. 17-10. Illinois Center for Nursing. There is created
9 the Illinois Center for Nursing to address issues of supply and
10 demand in the nursing profession, including issues of
11 recruitment, retention, and utilization of nurse manpower
12 resources. The General Assembly finds that the Center will
13 enhance the delivery of quality health care services by
14 providing an ongoing strategy for the allocation of the State's
15 resources directed towards nursing. Each of the following
16 objectives shall serve as the primary goals for the Center:
17         (1) To develop a strategic plan for nursing manpower in
18     Illinois by selecting priorities that must be addressed.
19         (2) To convene various groups of representatives of
20     nurses, other health care providers, businesses and
21     industries, consumers, legislators, and educators to:
22             (A) review and comment on data analysis prepared
23         for the Center;
24             (B) recommend systemic changes, including
25         strategies for implementation of recommended changes;
26         and
27             (C) evaluate and report the results of the Board's
28         efforts to the General Assembly and others.
29         (3) To enhance and promote recognition, reward, and
30     renewal activities for nurses in Illinois by:
31             (A) proposing and creating reward, recognition,
32         and renewal activities for nursing; and
33             (B) promoting media and positive image-building

1         efforts for nursing.
 
2     (225 ILCS 65/17-15 new)

4     Sec. 17-15. Center for Nursing Advisory Board.
5     (a) There is created the Center for Nursing Advisory Board,
6 which shall consist of 11 members appointed by the Governor,
7 with 6 members of the Board being nurses representative of
8 various nursing specialty areas. The other 5 members may
9 include representatives of associations, health care
10 providers, nursing educators, and consumers. The Board shall be
11 chaired by the Nursing Act Coordinator, who shall be a voting
12 member of the Board.
13     (b) The membership of the Board shall reasonably reflect
14 representation from the geographic areas in this State.
15     (c) Members of the Board appointed by the Governor shall
16 serve for terms of 4 years, with no member serving more than 10
17 successive years, except that, initially, 4 members shall be
18 appointed to the Board for terms that expire on June 30, 2009,
19 4 members shall be appointed to the Board for terms that expire
20 on June 30, 2008, and 3 members shall be appointed to the Board
21 for terms that expire on June 30, 2007. A member shall serve
22 until his or her successor is appointed and has qualified.
23 Vacancies shall be filled in the same manner as original
24 appointments, and any member so appointed shall serve during
25 the remainder of the term for which the vacancy occurred.
26     (d) A quorum of the Board shall consist of a majority of
27 Board members currently serving. A majority vote of the quorum
28 is required for Board decisions. A vacancy in the membership of
29 the Board shall not impair the right of a quorum to exercise
30 all of the rights and perform all of the duties of the Board.
31     (e) The Governor may remove any appointed member of the
32 Board for misconduct, incapacity, or neglect of duty and shall
33 be the sole judge of the sufficiency of the cause for removal.

1     (f) Members of the Board are immune from suit in any action
2 based upon any activities performed in good faith as members of
3 the Board.
4     (e) Members of the Board shall not receive compensation,
5 but shall be reimbursed for actual traveling, incidentals, and
6 expenses necessarily incurred in carrying out their duties as
7 members of the Board, as approved by the Department.

10     Sec. 17-20. Powers and duties of the Board.
11     (a) The Board shall be advisory to the Department and shall
12 possess and perform each of the following powers and duties:
13         (1) determine operational policy;
14         (2) administer grants, scholarships, internships, and
15     other programs, as defined by rule, including the
16     administration of programs, as determined by law, that
17     further those goals set forth in Section 17-10 of this
18     Title, in consultation with other State agencies, as
19     provided by law;
20         (3) establish committees of the Board as needed;
21         (4) recommend the adoption and, from time to time, the
22     revision of those rules that may be adopted and necessary
23     to carry out the provisions of this Act;
24         (5) implement the major functions of the Center, as
25     established in the goals set forth in Section 17-10 of this
26     Title; and
27         (6) seek and accept non-State funds for carrying out
28     the policy of the Center.
29     (b) The Center shall work in consultation with other State
30 agencies as necessary.
