| AMENDMENT TO SENATE BILL 622

| AMENDMENT NO. ______. Amend Senate Bill 622 by replacing | 3 |
| everything after the enacting clause with the following:

| "Section 5. The Department of State Police Law of the
Civil | 5 |
| Administrative Code of Illinois is amended by changing Section | 6 |
| 2605-327 as follows: | 7 |
| (20 ILCS 2605/2605-327) | 8 |
| Sec. 2605-327. Conviction and sex offender information for | 9 |
| medical school. Upon the inquiry
request of a medical school | 10 |
| under the Medical School Matriculant Criminal History Records | 11 |
| Check Act, to ascertain whether a matriculant of the medical | 12 |
| school has been convicted of any violent felony or has been | 13 |
| adjudicated a sex offender. | 14 |
| The Department shall make sex offender information | 15 |
| available to the inquiring medical school through the Statewide | 16 |
| Sex Offender Database. Medical schools in this State must | 17 |
| conduct an inquiry into the Statewide Sex Offender Database on | 18 |
| all matriculants as part of the admissions process.

| records database , and the Federal Bureau of Investigation | 2 |
| criminal history records database upon the request of a public | 3 |
| medical school . Pursuant to the Medical School Matriculant | 4 |
| Criminal History Records Check Act, the Department shall | 5 |
| conduct a fingerprint-based, Illinois Uniform Conviction | 6 |
| Information Act check of the Illinois criminal history records | 7 |
| database upon the request of a private medical school. The | 8 |
| Department may charge the requesting public or private medical | 9 |
| school a fee for conducting the fingerprint-based criminal | 10 |
| history records check. The fee shall not exceed the cost of the | 11 |
| inquiry and shall be deposited into the State Police Services | 12 |
| Fund.

| Section 10. The Medical School Matriculant Criminal | 15 |
| History Records Check Act is amended by changing Sections 10 | 16 |
| and 25 as follows: | 17 |

| Sec. 10. Criminal history records check for matriculants.

| (a) A public medical school located in Illinois
must | 20 |
| conduct an inquiry into the Department of State Police's | 21 |
| Statewide Sex Offender Database for each matriculant and must
| 22 |
| require that each matriculant submit to a fingerprint-based | 23 |
| criminal history records check for violent felony convictions ,
| 24 |
| and any adjudication of the matriculant as a sex offender
| 25 |
| conducted by the Department of State Police and the Federal | 26 |
| Bureau of Investigation , as part of the medical school | 27 |
| admissions process. The

| name, sex, race, date of birth, social security number, and | 29 |
| fingerprints of each of its matriculants to the Department of | 30 |

| and manner prescribed by the Department of State Police. The | 4 |
| Department of State Police shall furnish,
pursuant to positive | 5 |
| identification, records of a matriculant's
violent felony | 6 |
| convictions and any record of a matriculant's
adjudication as a | 7 |
| sex offender to the medical school that
requested the criminal | 8 |
| history records check.

| (b) A private medical school located in Illinois
must | 10 |
| conduct an inquiry into the Department of State Police's | 11 |
| Statewide Sex Offender Database for each matriculant and must | 12 |
| require that each matriculant submit to an Illinois Uniform | 13 |
| Conviction Information Act fingerprint-based, criminal history | 14 |
| records check for violent felony convictions, conducted by the | 15 |
| Department of State Police, as part of the medical school | 16 |
| admissions process. The medical school shall forward the name, | 17 |
| sex, race, date of birth, social security number, and | 18 |
| fingerprints of each of its matriculants to the Department of | 19 |
| State Police to be searched against the fingerprint records
now | 20 |
| and hereafter filed in the Department of State Police criminal | 21 |
| history records
database. The fingerprints of each matriculant | 22 |
| must be submitted in the form and manner prescribed by the | 23 |
| Department of State Police. The Department of State Police | 24 |
| shall furnish,
pursuant to positive identification, records of | 25 |
| a matriculant's
violent felony convictions to the medical | 26 |
| school that
requested the criminal history records check.

| Sec. 25. Civil immunity. Except for wilful or wanton | 30 |
| misconduct, no medical school acting under the provisions of | 31 |
| this Act shall be civilly liable to any matriculant for | 32 |
| reporting any required information to the Department of State | 33 |
| Police or for any decision made pursuant to Section 20 of this |
