1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.5 as follows:

7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 The State's Common School Fund, except as provided in Sections
11 Section 21.2 and 21.5.

14     Sec. 20. State Lottery Fund.
15     (a) There is created in the State Treasury a special fund
16 to be known as the "State Lottery Fund". Such fund shall
17 consist of all revenues received from (1) the sale of lottery
18 tickets or shares, (net of commissions, fees representing those
19 expenses that are directly proportionate to the sale of tickets
20 or shares at the agent location, and prizes of less than $600
21 which have been validly paid at the agent level), (2)
22 application fees, and (3) all other sources including moneys
23 credited or transferred thereto from any other fund or source
24 pursuant to law. Interest earnings of the State Lottery Fund
25 shall be credited to the Common School Fund.
26     (b) The receipt and distribution of moneys under Section
27 21.5 of this Act shall be in accordance with Section 21.5.

30     Sec. 21.5. Ticket For The Cure.

1     (a) The Department shall offer a special instant
2 scratch-off game with the title of "Ticket For The Cure". The
3 game shall commence on January 1, 2006 or as soon thereafter,
4 in the discretion of the Director, as is reasonably practical,
5 and shall be discontinued on December 31, 2011. The operation
6 of the game shall be governed by this Act and any rules adopted
7 by the Department. The Department must consult with the Ticket
8 For The Cure Board, which is established under Section 2310-347
9 of the Department of Public Health Powers and Duties Law of the
10 Civil Administrative Code of Illinois, regarding the design and
11 promotion of the game. If any provision of this Section is
12 inconsistent with any other provision of this Act, then this
13 Section governs.
14     (b) The Ticket For The Cure Fund is created as a special
15 fund in the State treasury. The net revenue from the Ticket For
16 The Cure special instant scratch-off game shall be deposited
17 into the Fund for appropriation by the General Assembly solely
18 to the Department of Public Health for the purpose of making
19 grants to public or private entities in Illinois for the
20 purpose of funding research concerning breast cancer and for
21 funding services for breast cancer victims. The Department
22 must, before grants are awarded, provide copies of all grant
23 applications to the Ticket For The Cure Board, receive and
24 review the Board's recommendations and comments, and consult
25 with the Board regarding the grants. For purposes of this
26 Section, the term "research" includes, without limitation,
27 expenditures to develop and advance the understanding,
28 techniques, and modalities effective in the detection,
29 prevention, screening, and treatment of breast cancer and may
30 include clinical trials. The grant funds may not be used for
31 institutional, organizational, or community-based overhead
32 costs, indirect costs, or levies.
33     Moneys received for the purposes of this Section,
34 including, without limitation, net revenue from the special
35 instant scratch-off game and gifts, grants, and awards from any
36 public or private entity, must be deposited into the Fund. Any

1 interest earned on moneys in the Fund must be deposited into
2 the Fund.
3     For purposes of this subsection, "net revenue" means the
4 total amount for which tickets have been sold less the sum of
5 the amount paid out in prizes and the actual administrative
6 expenses of the Department solely related to the Ticket For The
7 Cure game.
8     (c) During the time that tickets are sold for the Ticket
9 For The Cure game, the Department shall not unreasonably
10 diminish the efforts devoted to marketing any other instant
11 scratch-off lottery game.
12     (d) The Department may adopt any rules necessary to
13 implement and administer the provisions of this Section.
 
14     Section 10. The Department of Public Health Powers and
15 Duties Law of the Civil Administrative Code of Illinois is
16 amended by adding Section 2310-347 as follows:

18     Sec. 2310-347. The Ticket For The Cure Board.
19     (a) The Ticket For The Cure Board is created as an advisory
20 board within the Department. The Board shall consist of 10
21 members as follows: 2 members appointed by the President of the
22 Senate; 2 members appointed by the Minority Leader of the
23 Senate; 2 members appointed by the Speaker of the House of
24 Representatives; 2 members appointed by the Minority Leader of
25 the House of Representatives; and 2 members appointed by the
26 Governor with the advice and consent of the Senate, one of whom
27 shall be designated as chair of the Board at the time of
28 appointment.
29     If a vacancy occurs in the Board membership, the vacancy
30 shall be filled in the same manner as the initial appointment.
31     (b) Board members shall serve without compensation but may
32 be reimbursed for their reasonable travel expenses from funds
33 available for that purpose. The Department shall provide staff
34 and administrative support services to the Board.

1     (c) The Board must:
2         (i) consult with the Department of Revenue in designing
3     and promoting the Ticket For The Cure special instant
4     scratch-off lottery game; and
5         (ii) review grant applications, make recommendations
6     and comments, and consult with the Department of Public
7     Health in making grants, from amounts appropriated from the
8     Ticket For The Cure Fund, to public or private entities in
9     Illinois for the purpose of funding research concerning
10     breast cancer and for funding services for breast cancer
11     victims in accordance with Section 21.5 of the Illinois
12     Lottery Law.
13     (d) The Board is discontinued on June 30, 2012.

15     Section 15. The State Finance Act is amended by changing
16 Section 8h and by adding Section 5.640 as follows:

18     Sec. 5.640. The Ticket For The Cure Fund.

20     Sec. 8h. Transfers to General Revenue Fund.
21     (a) Except as provided in subsection (b), notwithstanding
22 any other State law to the contrary, the Governor may, through
23 June 30, 2007, from time to time direct the State Treasurer and
24 Comptroller to transfer a specified sum from any fund held by
25 the State Treasurer to the General Revenue Fund in order to
26 help defray the State's operating costs for the fiscal year.
27 The total transfer under this Section from any fund in any
28 fiscal year shall not exceed the lesser of (i) 8% of the
29 revenues to be deposited into the fund during that fiscal year
30 or (ii) an amount that leaves a remaining fund balance of 25%
31 of the July 1 fund balance of that fiscal year. In fiscal year
32 2005 only, prior to calculating the July 1, 2004 final
33 balances, the Governor may calculate and direct the State

1 Treasurer with the Comptroller to transfer additional amounts
2 determined by applying the formula authorized in Public Act
3 93-839 to the funds balances on July 1, 2003. No transfer may
4 be made from a fund under this Section that would have the
5 effect of reducing the available balance in the fund to an
6 amount less than the amount remaining unexpended and unreserved
7 from the total appropriation from that fund estimated to be
8 expended for that fiscal year. This Section does not apply to
9 any funds that are restricted by federal law to a specific use,
10 to any funds in the Motor Fuel Tax Fund, the Hospital Provider
11 Fund, the Medicaid Provider Relief Fund, or the Reviewing Court
12 Alternative Dispute Resolution Fund, or to any funds to which
13 subsection (f) of Section 20-40 of the Nursing and Advanced
14 Practice Nursing Act applies. Notwithstanding any other
15 provision of this Section, for fiscal year 2004, the total
16 transfer under this Section from the Road Fund or the State
17 Construction Account Fund shall not exceed the lesser of (i) 5%
18 of the revenues to be deposited into the fund during that
19 fiscal year or (ii) 25% of the beginning balance in the fund.
20 For fiscal year 2005 through fiscal year 2007, no amounts may
21 be transferred under this Section from the Road Fund, the State
22 Construction Account Fund, the Criminal Justice Information
23 Systems Trust Fund, the Wireless Service Emergency Fund, or the
24 Mandatory Arbitration Fund.
25     In determining the available balance in a fund, the
26 Governor may include receipts, transfers into the fund, and
27 other resources anticipated to be available in the fund in that
28 fiscal year.
29     The State Treasurer and Comptroller shall transfer the
30 amounts designated under this Section as soon as may be
31 practicable after receiving the direction to transfer from the
32 Governor.
33     (b) This Section does not apply to the Ticket For The Cure
34 Fund or to any fund established under the Community Senior
35 Services and Resources Act.

4     Section 99. Effective date. This Act takes effect upon
5 becoming law.
