AMENDMENT TO HOUSE BILL 2578

2     AMENDMENT NO. ______. Amend House Bill 2578, on page 2,
3 line 11, after the period, by inserting the following:
4 "The State agency or its employees shall not conduct any
5 counseling or testing required to be provided under this
6 subsection, but the agency shall make appropriate arrangements
7 with one or more local health organizations to conduct the
8 counseling or testing. The testing required to be provided
9 under this subsection is the rapid testing authorized under
10 Section 5.5 of the AIDS Confidentiality Act."; and
 
11 on page 2, after line 17, by inserting the following:
 
12     "Section 20. Study. The Illinois HIV/AIDS Policy and
13 Research Institute at Chicago State University shall conduct a
14 study to determine whether there is a correlation between
15 incarceration and HIV infection.
 
16     Section 25. HIV/AIDS Response Review Panel.
17     (a) The HIV/AIDS Response Review Panel is established
18 within the Department of Corrections. The Panel shall consist
19 of the following members:
20         (1) One member appointed by the Governor. This member
21     shall serve as the Chair of the Panel.
22         (2) One representative of each of the following,
23     appointed by the head of the department: the Department of

1     Corrections; the Department of Human Services; and the
2     Department of Public Health.
3         (3) Two ex-offenders who are familiar with the issue of
4     HIV/AIDS as it relates to incarceration, appointed by
5     Governor. One of these members must be from Cook County,
6     and the other must be from a county other than Cook. Both
7     of these members must have received a final discharge from
8     the Department of Corrections.
9         (4) Three representatives of HIV/AIDS organizations
10     that have been in business for at least 2 years, appointed
11     by Governor. In the case of such an organization that
12     represents a constituency the majority of whom are
13     African-American, the organization's representative who is
14     a member of the Panel must be African-American.
15     (b) The Panel shall review the implementation of this Act
16 within the Department of Corrections and shall file a report
17 with the General Assembly and with the Governor every January 1
18 stating the results of its review."; and
 
19 on page 2, line 18, by changing "Section 20" to "Section 30";
20 and
 
21 on page 2, after line 28, by inserting the following:
22     "(c) The Department of Human Services, the Department of
23 Public Health, the Department of Corrections, and the
24 Department of Central Management Services shall adopt rules as
25 necessary to ensure that this Act is implemented within 6
26 months after the effective date of this Act."; and
 
27 on page 13, line 2, after the period, by inserting the
28 following: "An employee of the Department may not directly or
29 indirectly disclose the HIV/AIDS status of a person committed
30 to the Department, or any other information related to HIV/AIDS
31 testing, medical care, counseling, or case management with

1 respect to a person committed to the Department, to any other
2 person unless authorized to do so by the person committed to
3 the Department."; and
 
4 on page 18, line 3, after the period, by inserting the
5 following: "The Department shall ensure that all such
6 information and materials are culturally sensitive and reflect
7 cultural diversity as appropriate.".
