AMENDMENT TO HOUSE BILL 2241

2     AMENDMENT NO. ______. Amend House Bill 2241 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2605-480 as follows:
 
7     (20 ILCS 2605/2605-480)
8     Sec. 2605-480. Statewide kidnapping alert and prevention
9 program; Child and Senior Safety Coordinator; reports of
10 missing endangered seniors.
11     (a) The Department of State Police shall develop a
12 coordinated program for a statewide emergency alert system when
13 a child is missing or kidnapped or a senior is missing and
14 endangered. The system shall include, but is not limited to,
15 the use in coordination with the Illinois Department of
16 Transportation, of electronic message signs on roads and
17 highways in the vicinity of a child abduction or the vicinity
18 where a missing endangered senior was last seen to immediately
19 provide critical information to the public.
20     (b) The Department of State Police shall establish an AMBER
21 Plan Task Force to monitor and review the implementation and
22 operation of the system developed under subsection (a),
23 including procedures, budgetary requirements, and response
24 protocols. The Task Force shall also develop additional network

1 resources for use in the system.
2     (c) The Department of State Police, in coordination with
3 the Illinois Emergency Management Agency, shall develop and
4 implement a community outreach program to promote awareness
5 among citizens of the State the State's parents and children of
6 child abduction and senior endangerment prevention and
7 response.
8     (d) The Department of State Police, in coordination with
9 the State Board of Education, shall develop child abduction
10 prevention instruction for inclusion in elementary and
11 secondary school curricula throughout the State. The
12 Department and State Board of Education shall encourage the
13 inclusion of the child abduction prevention instruction in
14 private elementary and secondary school curricula throughout
15 the State.
16     (e) The Department shall appoint a Child and Senior Safety
17 Coordinator to assist in the establishment of State standards
18 for child and senior safety from kidnap, and abduction, and
19 endangerment and to advocate for the achievement of those
20 standards. The Child and Senior Safety Coordinator shall have
21 the qualifications and experience that the Department shall
22 require by rule. The Child and Senior Safety Coordinator shall
23 receive no compensation but shall be reimbursed for his or her
24 expenses from the Department's operations budget. No funds
25 shall be appropriated solely for the expenses of the Child and
26 Senior Safety Coordinator. The Department shall provide
27 technical assistance for the Child and Senior Safety
28 Coordinator from its existing resources.
29     (f) If the Department of State Police receives a
30 notification concerning a missing endangered senior, it shall
31 prepare a report on the missing endangered senior. The report
32 must include all of the following:
33         (1) Relevant information obtained from the
34     notification concerning the missing endangered senior,

1     including all of the following:
2             (A) a physical description of the missing
3         endangered senior;
4             (B) the date, time, and place that the missing
5         endangered senior was last seen; and
6             (C) the missing endangered senior's address.
7         (2) Information gathered by a preliminary
8     investigation, if one was made.
9         (3) A statement by the law enforcement officer in
10     charge stating the officer's assessment of the case based
11     on the evidence and information received.
12     The Department of State Police shall prepare the report
13 required by this subsection (f) as soon as practicable, but not
14 later than 5 hours after the Department receives notification
15 of a missing endangered senior.
16     (g) Upon completion of the report required by subsection
17 (f) the Department of State Police shall immediately forward
18 the contents of the report to all of the following:
19         (1) all law enforcement agencies that have
20     jurisdiction in the location where the missing endangered
21     senior lives and all law enforcement agencies that have
22     jurisdiction in the location where the missing endangered
23     senior was last seen;
24         (2) all law enforcement agencies to which the person
25     who made the notification concerning the missing
26     endangered senior requests the report be sent, if the
27     Department determines that the request is reasonable in
28     light of the information received;
29         (3) all law enforcement agencies that request a copy of
30     the report; and
31         (4) the National Crime Information Center's Missing
32     Person File, if appropriate.
33     (h) The Department of State Police shall begin an
34 investigation concerning the missing endangered senior not

1 later than 24 hours after receiving notification of a missing
2 endangered senior.
3     (i) For the purposes of this Section, "missing endangered
4 senior" means an individual 65 years of age or older who is
5 reported missing to a law enforcement agency and is, or is
6 believed to be:
7         (1) a temporary or permanent resident of Illinois;
8         (2) at a location that cannot be determined by an
9     individual familiar with the missing individual; and
10         (3) incapable of returning to the individual's
11     residence without assistance.

14     Section 10. The Illinois Police Training Act is amended by
15 changing Section 10.10 as follows:
 
16     (50 ILCS 705/10.10)
17     Sec. 10.10. Training in child abduction and missing
18 endangered senior alert system. The Board shall conduct a
19 training program for law enforcement personnel of local
20 governmental agencies in the statewide coordinated child
21 abduction and missing endangered senior alert system developed
22 under Section 2605-480 of the Department of State Police Law of
23 the Civil Administrative Code of Illinois.

25     Section 99. Effective date. This Act takes effect July 1,
26 2006.".
