Amends the Hospital Licensing Act. Provides that a hospital must report to the trauma registry any accident in which a person under the age of 18 years was injured that involved a motor vehicle or the power window of a motor vehicle. Amends the Vital Records Act. Provides that, if the decedent was under the age of 18 years at the time of his or her death, and the death was due to injuries suffered as a result of a motor vehicle backing over a child, or if the death occurred due to the power window of a motor vehicle, the attending physician or the coroner must send a copy of the medical or death certificate to the Illinois Department of Children and Family Services. Effective immediately.

| AN ACT in relation to public health.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Hospital Licensing Act is amended by adding | 5 |
| Section 6.14f as follows: | 6 |
| (210 ILCS 85/6.14f new) | 7 |
| Sec. 6.14f. Reports to the trauma registry; certain | 8 |
| accidents involving persons under the age of 18 years. A | 9 |
| hospital that treats any person under the age of 18 years for | 10 |
| injuries suffered in an accident involving a motor vehicle or | 11 |
| the power window of a motor vehicle must report the accident to | 12 |
| the trauma registry. | 13 |
| Section 10. The Vital Records Act is amended by changing | 14 |
| Section 18 as follows:

| Sec. 18. (1) Each death which occurs in this State shall be | 17 |
| registered
by filing a death certificate with the local | 18 |
| registrar
of the district in which the death occurred or the | 19 |
| body was found, within
7 days after such death (within 5 days | 20 |
| if the death occurs prior to
January 1, 1989) and prior to | 21 |
| cremation or removal of the body from
the State, except when | 22 |
| death is subject to investigation by the coroner or
medical | 23 |
| examiner.
| 24 |
| (a) For the purposes of this Section, if the place of | 25 |
| death is unknown,
a death certificate shall be filed in the | 26 |
| registration district in which
a dead body is found, which | 27 |
| shall be considered the place of death.
| 28 |
| (b) When a death occurs on a moving conveyance, the | 29 |
| place where the body
is first removed from the conveyance | 30 |
| shall be considered the place of death
and a death |

| certificate shall be filed in the registration district in
| 2 |
| which such place is located.
| 3 |
| (c) The funeral director who first assumes
custody of a | 4 |
| dead body shall be responsible for filing a completed death
| 5 |
| certificate. He shall obtain the personal data from the | 6 |
| next
of kin or the best qualified person or source | 7 |
| available; he shall enter
on the certificate the name, | 8 |
| relationship,
and address of his informant; he shall enter | 9 |
| the date, place, and method
of final disposition; he shall | 10 |
| affix his own signature and enter his address;
and shall | 11 |
| present the certificate to the person responsible for | 12 |
| completing
the medical certification of cause of death.
| 13 |
| (2) The medical certification shall be completed and signed | 14 |
| within 48
hours after death by the physician in charge of the | 15 |
| patient's care for the
illness or condition which resulted in | 16 |
| death, except when death is subject
to the coroner's or medical | 17 |
| examiner's investigation. In the absence of
the physician or | 18 |
| with his approval, the medical certificate may be
completed and | 19 |
| signed by his associate physician, the chief medical officer
of | 20 |
| the institution in which death occurred or by the physician who
| 21 |
| performed an autopsy upon the decedent. If the decedent was | 22 |
| under the age of 18 years at the time of his or her death, and | 23 |
| the death was due to injuries suffered as a result of a motor | 24 |
| vehicle backing over a child, or if the death occurred due to | 25 |
| the power window of a motor vehicle, the physician must send a | 26 |
| copy of the medical certificate to the Illinois Department of | 27 |
| Children and Family Services.
| 28 |
| (3) When a death occurs without medical attendance, or when | 29 |
| it is otherwise
subject to the coroner's or medical examiner's | 30 |
| investigation, the coroner
or medical examiner shall be | 31 |
| responsible for the completion of a coroner's
or medical | 32 |
| examiner's certificate of death and shall sign the medical
| 33 |
| certification within 48 hours after death, except as provided | 34 |
| by regulation
in special problem cases. If the decedent was | 35 |
| under the age of 18 years at the time of his or her death, and | 36 |
| the death was due to injuries suffered as a result of a motor |

| vehicle backing over a child, or if the death occurred due to | 2 |
| the power window of a motor vehicle, the coroner must send a | 3 |
| copy of the death certificate to the Illinois Department of | 4 |
| Children and Family Services.

| (3.5) The medical certification of cause of death shall | 6 |
| expressly provide
an
opportunity for the person completing the
| 7 |
| certification to indicate that the death was caused in whole or | 8 |
| in part by a
dementia-related disease, Parkinson's Disease, or | 9 |
| Parkinson-Dementia Complex.
| 10 |
| (4) When the deceased was a veteran of any war of the | 11 |
| United States, the
funeral director shall prepare a | 12 |
| "Certificate of Burial of U. S. War Veteran",
as prescribed and | 13 |
| furnished by the Illinois Department of Veterans Affairs,
and | 14 |
| submit such certificate to the Illinois Department of Veterans | 15 |
| Affairs
monthly.
| 16 |
| (5) When a death is presumed to have occurred in this State | 17 |
| but the
body cannot be located, a death certificate may be | 18 |
| prepared by the State
Registrar upon receipt of an order of a | 19 |
| court of competent jurisdiction
which includes the finding of | 20 |
| facts required to complete the death
certificate. Such death | 21 |
| certificate shall be marked "Presumptive" and shall
show on its | 22 |
| face the date of the registration and shall identify the court
| 23 |
| and the date of the judgment.

| Section 99. Effective date. This Act takes effect upon | 26 |
| becoming law.
