AMENDMENT TO HOUSE BILL 323

2     AMENDMENT NO. ______. Amend House Bill 323, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The State Vehicle Identification Act is amended
6 by changing Section 4 and by adding Section 4.5 as follows:
 
7     (30 ILCS 610/4)  (from Ch. 127, par. 133e4)
8     Sec. 4. Sections 2 and 3 This Act shall not apply to
9 vehicles used by elective State officers, by executive heads of
10 State agencies and departments, by presidents of colleges or
11 universities placed under control of officers of this State, or
12 by any employee of a State agency or department in the
13 performance of investigative services exclusively when the
14 executive head thereof has requested an exception in writing,
15 and such exception has been approved in writing by the
16 Department, on the basis that the identification would hamper
17 the individual employee in the routine performance of his
18 investigative duties. A record, open to public inspection,
19 shall be kept by the Department of all such exceptions approved
20 by it.
21     Sections 2 and 3 This Act shall not apply to vehicles
22 assigned to the use of the Department of State Police and the
23 Division of Law Enforcement of the Department of Natural
24 Resources, and the executive heads thereof shall have within

1 their discretion determination of the type of markings or
2 identification, if any, to be affixed to vehicles assigned to
3 said Department or Division nor shall Sections 2 and 3 this Act
4 apply to vehicles assigned to the use of Secretary of State
5 police officers.

8     Sec. 4.5. Identifying markings.
9     (a) In order that vehicles are identifiable as State
10 property, each vehicle owned by the State shall bear
11 identifying markings on the front, side, or rear of the vehicle
12 and the markings may include the use of window decals. Decals
13 and markings shall have a small State seal and the name of the
14 State agency using the vehicle.
15     (b) A State agency shall make exemptions to the requirement
16 of subsection (a) for reasonable security purposes by adoption
17 of rules in accordance with the Illinois Administrative
18 Procedure Act. Agencies making exemptions shall notify the
19 Department of Central Management Services. The Department
20 shall maintain a list of exemptions from the requirement of
21 subsection (a). The listing shall not be made available to the
22 public and is exempt from the disclosure requirements of
23 Section 7 of the Freedom of Information Act.
24     (c) This Section does not apply to vehicles assigned to
25 members of the General Assembly and employees of the
26 legislative branch of State government.
27     (d) This Section shall not apply to vehicles assigned to
28 the use of the Department of State Police and the Division of
29 Law Enforcement of the Department of Natural Resources, and the
30 executive heads thereof have within their discretion
31 determination of the type of markings or identification, if
32 any, to be affixed to vehicles assigned to that Department or
