AMENDMENT TO SENATE BILL 2880

2     AMENDMENT NO. ______. Amend Senate Bill 2880 on page 1, by
3 replacing lines 9 and 10 with the following: "affordable, and
4 sustainable system of housing, health, and supportive services
5 for older residents of"; and
 
6 on page 1, by replacing line 25 with "housing, health, and
7 supportive services, regardless"; and
 
8 on page 1, line 26, before "setting", by inserting
9 "residential"; and
 
10 on page 1, after line 26, by inserting the following:
11     ""Coordinating Committee" means the Housing, Health, and
12 Supportive Services for Older Adults Coordinating Committee.";
13 and
 
14 on page 1, line 29, by deleting "services"; and
 
15 on page 2, lines 5 and 6, by deleting "housing, health
16 services, or supportive service"; and
 
17 on page 2, by replacing line 7 with the following: "access

18     "Section 37. Housing, Health, and Supportive Services for
19 Older Adults Coordinating Committee.
20     (a) The Governor shall appoint the Housing, Health, and
21 Supportive Services for Older Adults Coordinating Committee.
22     (b) The Committee shall be comprised of the following
23 persons:
24         (1) the Director of Aging, who shall serve as chair, ex
25 officio and nonvoting;

1         (2) the directors of Public Aid and Public Health, who
2 shall serve as vice chairs, ex officio and nonvoting;
3         (3) one representative each of the departments of
4 Public Aid, Public Health, Human Services, Insurance, and
5 Commerce and Economic Opportunity, the Department on
6 Aging, the Office of the State Ombudsman, and the Illinois
7 Finance Authority, all nonvoting members;
8         (4) one member selected from the recommendations of the
9 statewide organization representing the Area Agencies on
10 Aging;
11         (5) four members selected from the recommendations of
12 statewide provider organizations whose membership consists
13 of nursing homes or assisted living establishments;
14         (6) one member selected from the recommendations of the
15 statewide provider organization whose membership consists
16 of home health agencies;
17         (7) one member selected from the recommendations of the
18 statewide provider organization whose membership provides
19 case coordination services;
20         (8) two members selected from the recommendations of
21 statewide senior center associations;
22         (9) one member selected from the recommendations of
23 statewide provider organizations whose membership provides
24 community care homemaker services;
25         (10) one member selected from the recommendations of
26 the statewide provider organization whose membership
27 provides community care adult day services;
28         (11) one member selected from the recommendations of
29 the statewide provider organization representing nutrition
30 project directors;
31         (12) two members selected from the recommendations of
32 statewide membership-based organizations that engage
33 solely in advocacy or legal representation on behalf of the
34 senior population;

1         (13) one member selected from the recommendations of
2 organizations representing individuals with Alzheimer's
3 disease and related dementias;
4         (14) two members selected from the recommendations of
5 statewide trade or labor unions;
6         (15) a professional nurse selected from the
7 recommendations of statewide professional nursing
8 associations; and
9         (16) a physician specializing in gerontology selected
10 from the recommendations of statewide organizations
11 representing physicians;
12     (c) Members of the Committee appointed under paragraphs (4)
13 through (16) of subsection (b) shall be appointed to serve for
14 terms of 3 years except as otherwise provided in this
15 subsection. All such members shall be appointed no later than
16 January 1, 2005. Six of those members' initial terms shall
17 expire in one year; six in 2 years, and seven in 3 years. A
18 member's term does not expire until a successor is appointed by
19 the Governor. Any member appointed to fill a vacancy occurring
20 prior to the expiration of the term for which his or her
21 predecessor was appointed shall be appointed for the remainder
22 of that term.
23     (d) The Committee shall meet at the call of the Director of
24 Aging. The affirmative vote of 10 members of the Committee
25 shall be necessary for Committee action.
26     (e) Members of the Committee shall receive no compensation
27 for their services.
 
28     Section 40. Statewide system of comprehensive case
29 management services; quality improvement."; and

14     Sec. 8h. Transfers to General Revenue Fund.
15     (a) Except as provided in subsection (b), notwithstanding
16 Notwithstanding any other State law to the contrary, the
17 Director of the Governor's Office of Management and Budget may
18 from time to time direct the State Treasurer and Comptroller to
19 transfer a specified sum from any fund held by the State
20 Treasurer to the General Revenue Fund in order to help defray
21 the State's operating costs for the fiscal year. The total
22 transfer under this Section from any fund in any fiscal year
23 shall not exceed the lesser of 8% of the revenues to be
24 deposited into the fund during that year or 25% of the
25 beginning balance in the fund. No transfer may be made from a
26 fund under this Section that would have the effect of reducing

1 the available balance in the fund to an amount less than the
2 amount remaining unexpended and unreserved from the total
3 appropriation from that fund for that fiscal year. This Section
4 does not apply to any funds that are restricted by federal law
5 to a specific use or to any funds in the Motor Fuel Tax Fund or
6 the Hospital Provider Fund. Notwithstanding any other
7 provision of this Section, the total transfer under this
8 Section from the Road Fund or the State Construction Account
9 Fund shall not exceed 5% of the revenues to be deposited into
10 the fund during that year.
11     In determining the available balance in a fund, the
12 Director of the Governor's Office of Management and Budget may
13 include receipts, transfers into the fund, and other resources
14 anticipated to be available in the fund in that fiscal year.
15     The State Treasurer and Comptroller shall transfer the
16 amounts designated under this Section as soon as may be
17 practicable after receiving the direction to transfer from the
18 Director of the Governor's Office of Management and Budget.
19     (b) This Section does not apply to the Nursing Home
20 Conversion Fund, the Nursing Home Transition Planning Grant
21 Fund, or the Long-Term Care Services for Older Adults Fund.
