AMENDMENT TO SENATE BILL 2845

2     AMENDMENT NO. ______. Amend Senate Bill 2845 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 2310-215 as follows:
 
7     (20 ILCS 2310/2310-215)  (was 20 ILCS 2310/55.62)
8     Sec. 2310-215. Center for Minority Health Services.
9     (a) The Department shall establish a Center for Minority
10 Health Services to advise the Department on matters pertaining
11 to the health needs of minority populations within the State.
12     (b) The Center shall have the following duties:
13         (1) To assist in the assessment of the health needs of
14 minority populations in the State.
15         (2) To recommend treatment methods and programs that
16 are sensitive and relevant to the unique linguistic,
17 cultural, and ethnic characteristics of minority
18 populations.
19         (3) To provide consultation, technical assistance,
20 training programs, and reference materials to service
21 providers, organizations, and other agencies.
22         (4) To promote awareness of minority health concerns,
23 and encourage, promote, and aid in the establishment of
24 minority services.

1         (5) To disseminate information on available minority
2 services.
3         (6) To provide adequate and effective opportunities
4 for minority populations to express their views on
5 Departmental policy development and program
6 implementation.
7         (7) To coordinate with the Department on Aging and the
8 Department of Public Aid to coordinate services designed to
9 meet the needs of minority senior citizens.
10         (8) To promote awareness of the incidence of
11 Alzheimer's disease and related dementias among minority
12 populations and to encourage, promote, and aid in the
13 establishment of prevention and treatment programs and
14 services relating to this health problem.
15     (c) For the purpose of this Section, "minority" shall mean
16 and include any person or group of persons who are:
17         (1) African-American (a person having origins in any of
18 the black racial groups in Africa);
19         (2) Hispanic (a person of Spanish or Portuguese culture
20 with origins in Mexico, South or Central America, or the
21 Caribbean Islands, regardless of race);
22         (3) Asian American (a person having origins in any of
23 the original peoples of the Far East, Southeast Asia, the
24 Indian Subcontinent or the Pacific Islands); or
25         (4) American Indian or Alaskan Native (a person having
26 origins in any of the original peoples of North America).

28     Section 10. The State Finance Act is amended by adding
29 Section 5.625 as follows:

31     Sec. 5.625. The Alzheimer's Disease Center Fund.

1     Section 15. The Excellence in Academic Medicine Act is
2 amended by changing Section 20 and by adding Section 36 as
3 follows:
 
4     (30 ILCS 775/20)
5     Sec. 20. Establishment of Funds.
6     (a) The Medical Research and Development Fund is created in
7 the State Treasury to which the General Assembly may from time
8 to time appropriate funds and from which the Comptroller shall
9 pay amounts as authorized by law.
10         (i) The following accounts are created in the Medical
11 Research and Development Fund: The National Institutes of
12 Health Account; the Philanthropic Medical Research
13 Account; and the Market Medical Research Account.
14         (ii) Funds appropriated to the Medical Research and
15 Development Fund shall be assigned in equal amounts to each
16 account within the Fund, subject to transferability of
17 funds under subsection (c) of Section 25.
18     (b) The Post-Tertiary Clinical Services Fund is created in
19 the State Treasury to which the General Assembly may from time
20 to time appropriate funds and from which the Comptroller shall
21 pay amounts as authorized by law.
22     (c) The Independent Academic Medical Center Fund is created
23 as a special fund in the State Treasury, to which the General
24 Assembly shall from time to time appropriate funds for the
25 purposes of the Independent Academic Medical Center Program.
26 The amount appropriated for any fiscal year after 2002 shall
27 not be less than the amount appropriated for fiscal year 2002.
28 The State Comptroller shall pay amounts from the Fund as
29 authorized by law.
30     (d) The Alzheimer's Disease Center Fund is created as a
31 special fund in the State Treasury, to which the General
32 Assembly shall from time to time appropriate funds for the
33 operation of the Alzheimer's Disease Center Program. The State

1 Comptroller shall pay amounts from the Fund as authorized by
2 law.

4     (30 ILCS 775/36 new)
5     Sec. 36. Alzheimer's Disease Center Program. There is
6 created an Alzheimer's Disease Center Program to provide
7 financial incentives to the Regional Alzheimer's Disease
8 Assistance Centers established under the Alzheimer's Disease
9 Assistance Act. In each state fiscal year, beginning July 1,
10 2004, each center shall receive funding under the program from
11 the funds appropriated for that purpose for that fiscal year.
12 The methodology to be used by the Illinois Department of Public
13 Aid shall be reviewed by the Advisory Committee established
14 under the Alzheimer's Disease Assistance Act and prescribed by
15 rule.
 
16     Section 20. The Alzheimer's Disease Assistance Act is
17 amended by changing Sections 2, 6, and 7 as follows:
 
18     (410 ILCS 405/2)  (from Ch. 111 1/2, par. 6952)
19     Sec. 2. Policy declaration. The General Assembly finds that
20 Alzheimer's disease and related disorders are devastating
21 health conditions which destroy certain vital cells of the
22 brain and which affect an estimated 4,500,000 1,500,000
23 Americans. This means that approximately 200,000 111,000
24 Illinois citizens are victims. The General Assembly also finds
25 that 50% of all nursing home admissions in the State may be
26 attributable to the Alzheimer's disease and related disorders
27 and that these conditions are the fourth leading cause of death
28 among the elderly. It is the opinion of the General Assembly
29 that Alzheimer's disease and related disorders cause serious
30 financial, social and emotional hardships on the victims and
31 their families of such a major consequence that it is essential

1 for the State to develop and implement policies, plans,
2 programs and services to alleviate such hardships.
3     The General Assembly recognizes that there is no known
4 cause or cure of Alzheimer's disease at this time, and that it
5 can progress over an extended period of time and to such a
6 degree that the victim's deteriorated condition makes him or
7 her susceptible to other medical disorders that generally prove
8 fatal. It is the intent of the General Assembly, through
9 implementation of this Act, to establish a program for the
10 conduct of research regarding the cause, cure and treatment of
11 Alzheimer's disease and related disorders; and, through the
12 establishment of Regional Alzheimer's Disease Assistance
13 Centers and a comprehensive, Statewide system of regional and
14 community-based services, to provide for the identification,
15 evaluation, diagnosis, referral and treatment of victims of
16 such health problems.

19     Sec. 6. ADA Advisory Committee. There is created the
20 Alzheimer's Disease Advisory Committee consisting of 21 voting
21 members appointed by the Director of the Department, as well as
22 5 nonvoting members as hereinafter provided in this Section.
23 The Director or his designee shall serve as one of the 21
24 voting members and as the Chairman of the Committee. Those
25 appointed as voting members shall include persons who are
26 experienced in research and the delivery of services to victims
27 and their families. Such members shall include 4 physicians
28 licensed to practice medicine in all of its branches, one
29 representative of a postsecondary educational institution
30 which administers or is affiliated with a medical center in the
31 State, one representative of a licensed hospital, one
32 registered nurse, one representative of a long term care
33 facility under the Nursing Home Care Act, one representative of

1 an area agency on aging as defined by Section 3.07 of the
2 Illinois Act on the Aging, one social worker, one
3 representative of an organization established under the
4 Illinois Insurance Code for the purpose of providing health
5 insurance, 5 family members or representatives of victims of
6 Alzheimer's disease and related disorders, and 4 members of the
7 general public. Among the physician appointments shall be
8 persons with specialties in the fields of neurology, family
9 medicine, psychiatry and pharmacology. Among the general
10 public members, at least 2 appointments shall include persons
11 65 years of age or older.
12     In addition to the 21 voting members, the Secretary of
13 Human Services (or his or her designee) and one additional
14 representative of the Department of Human Services designated
15 by the Secretary plus the Directors of the following State
16 agencies or their designees shall serve as nonvoting members:
17 Department on Aging, Department of Public Aid, and Guardianship
18 and Advocacy Commission.
19     Each voting member appointed by the Director of Public
20 Health shall serve for a term of 2 years, and until his
21 successor is appointed and qualified. Members of the Committee
22 shall not be compensated but shall be reimbursed for expenses
23 actually incurred in the performance of their duties. No more
24 than 11 voting members may be of the same political party.
25 Vacancies shall be filled in the same manner as original
26 appointments.
27     The Committee shall review and evaluate State programs and
28 services provided by State agencies that are directed toward
29 persons with Alzheimer's disease and related dementias, and
30 recommend changes to improve the State's response to this
31 serious health problem.

1     Sec. 7. Regional ADA center funding. Pursuant to
2 appropriations enacted by the General Assembly, the Department
3 shall provide funds to hospitals affiliated with each Regional
4 ADA Center for necessary research and for the development and
5 maintenance of services for victims of Alzheimer's disease and
6 related disorders and their families. For the fiscal year
7 beginning July 1, 2003, and each year thereafter, the
8 Department shall effect payments under this Section to
9 hospitals affiliated with each Regional ADA Center through the
10 Illinois Department of Public Aid under the Excellence in
11 Academic Medicine Act. The Department of Public Aid shall
12 consult with the Advisory Committee established under this Act
13 prior to implementing the payment methodology, and each year
14 thereafter to ensure that the purpose of this Act and the goals
15 and objectives of the State are being realized. The Department
16 shall include the annual expenditures for this purpose in the
17 plan required by Section 5 of this Act.
