1 AMENDMENT TO SENATE BILL 1459
2 AMENDMENT NO. . Amend Senate Bill 1459 by replacing
3 eveything after the enacting clause with the following:
4 "Section 5. The Illinois Governmental Ethics Act is
5 amended by changing Section 2-110 as follows:
6 (5 ILCS 420/2-110)
7 Sec. 2-110. Honoraria.
8 (a) No memberMembers of the General Assembly shallmay
9 accept any honorarium except from a person or entity
10 registered under the Lobbyist Registration Act, or a
11 prohibited source as defined under the Gift Ban Act.
12 (b) As used in this Section:
13 "Honorarium" means a payment of money to a member of the
14 General Assembly for an appearance or speech, excluding any
15 actual and necessary travel expenses incurred by the member
16 of the General Assembly (and one relative) to the extent that
17 those expenses are paid by any other person. "Honorarium"
18 does not include (i) cash payments made on behalf of a member
19 of the General Assembly to an organization described under
20 Section 501(c)(3) of the Internal Revenue Code of 1986, (ii)
21 an agent's fee or commission, or (iii) funds reported under
22 Article 9 of the Election Code.
23 "Travel expense" means the reasonable cost of

1 transportation and the reasonable cost of lodging and meals
2 incurred while a person is away from his or her residence or
3 principal place of employment.
4 (c) Any honorarium or honoraria accepted in violation of
5 this Section shall be surrendered to the State Treasurer and
6 deposited into the General Revenue Fund.

8 Section 99. Effective date. This Act takes effect upon
9 becoming law.".
