 1                    AMENDMENT TO SENATE BILL 748

 2        AMENDMENT NO.     .  Amend Senate Bill 748  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The Southern Illinois University Management
 5    Act is amended by changing Sections 2, 4, and 5 as follows:

 6        (110 ILCS 520/2) (from Ch. 144, par. 652)
 7        Sec. 2. Members of Board; appointment;  student  members;
 8    selection. The term of each appointed member of the Board who
 9    is in office on June 30, 2003 shall terminate at the close of
10    business  on  that  date or when all of the new members to be
11    initially appointed under this amendatory  Act  of  the  93rd
12    General   Assembly  have  been  appointed  by  the  Governor,
13    whichever occurs  later.  The  Board  shall  consist  of  the
14    following  7  members  appointed by the Governor, by and with
15    the advice and consent of the Senate, for terms beginning  on
16    July  1,  2003,  or as soon as possible thereafter, 3 of whom
17    shall  be  graduates  of  Southern  Illinois  University   at
18    Carbondale,  Southern  Illinois  University School of Law, or
19    Southern Illinois University School of Medicine or reside  in
20    Johnson,  Randolph,  Perry,  Franklin,  Williamson,  Jackson,
21    Massac,  Hardin,  Pope,  Saline,  Hamilton,  White, Gallatin,
22    Alexander, Pulaski,  or Union County,  3  of  whom  shall  be

 1    graduates  of Southern Illinois University at Edwardsville or
 2    Southern Illinois School of Dentistry or reside  in  Madison,
 3    St.  Clair,  Bond,  Macoupin,  Clinton,  Fayette, Montgomery,
 4    Washington, or Monroe County, and one  of  whom  shall  be  a
 5    resident   of   this  State,  the  Superintendent  of  Public
 6    Instruction, or his chief assistant for liaison  with  higher
 7    education  when designated to serve in his place, ex-officio,
 8    and one voting student member designated by the Governor from
 9    each one campus of the University and one  nonvoting  student
10    member  from  the campus of the University not represented by
11    the voting student member.  The Governor shall designate  one
12    of  the  student members serving on the Board to serve as the
13    voting student member.  Each student member shall  be  chosen
14    by the respective campuses of Southern Illinois University at
15    Carbondale  and  Edwardsville.   The method of choosing these
16    student members shall be by campus-wide student election, and
17    any student designated by the Governor to be a voting student
18    member shall be one of the students chosen  by  this  method.
19    The  student  members shall serve terms of one year beginning
20    on July 1 of each  year,  except  that  the  student  members
21    initially  selected  shall serve a term beginning on the date
22    of such selection and expiring on the  next  succeeding  June
23    30.   To be eligible for selection as a student member and to
24    be eligible to remain as a voting or nonvoting student member
25    of the Board, a student member must be  a  resident  of  this
26    State,  must  have and maintain a grade point average that is
27    equivalent to at least 2.5 on a 4.0 scale, and must be a full
28    time student enrolled at all times during his or her term  of
29    office  except  for  that  part of the term which follows the
30    completion of the last full regular semester of  an  academic
31    year  and  precedes  the  first  full regular semester of the
32    succeeding  academic  year  at  the   university   (sometimes
33    commonly referred to as the summer session or summer school).
34    If  a voting or nonvoting student member serving on the Board

 1    fails to continue to meet or maintain the residency,  minimum
 2    grade point average, or enrollment requirement established by
 3    this  Section,  his  or  her membership on the Board shall be
 4    deemed to have terminated by operation of law.  No more  than
 5    4   of  the  members  appointed  by  the  Governor  shall  be
 6    affiliated  with  the  same  political  party.   Each  member
 7    appointed by the Governor must be a resident of  this  State.
 8    A  failure  to  meet  or  maintain this residency requirement
 9    constitutes a resignation from and creates a vacancy  in  the
10    Board.  Of the members initially appointed by the Governor on
11    or after July 1, 2003, 2 members shall serve for terms ending
12    June  30,  2005,  2 members shall serve for terms ending June
13    30, 2007, and the remaining members  shall  serve  for  terms
14    ending  June  30,  2009.  Upon the expiration of the terms of
15    members initially appointed by the Governor on or after  July
16    1,  2003,  their respective successors shall be appointed for
17    terms of 6 years from the third Monday  in  January  of  each
18    odd-numbered  year  and until their respective successors are
19    appointed for like terms.  If the Senate is  not  in  session
20    appointments shall be made as in the case of vacancies.

24        Sec.  4.   Members  of  the  Board  shall  serve  without
25    compensation but shall be entitled to reasonable amounts  for
26    expenses  necessarily  incurred  in  the performance of their
27    duties.  Such expenses incurred  by  any  non-voting  student
28    member  may, at the discretion of the Chairperson Chairman of
29    the Board, be provided for by advance payment to the  student
30    such   member,  who  shall  account  therefor  to  the  Board
31    immediately after each meeting.
32        No member of the Board shall hold or be  employed  in  or
33    appointed  to  any office or place under the authority of the

 1    Board, nor shall any member  of  the  Board  be  directly  or
 2    indirectly  interested in any contract made by the Board, nor
 3    shall he or she be  an  employee  of  the  State  or  federal
 4    government.   This  Section  does  not  prohibit  the student
 5    members of the Board from  maintaining  normal  and  official
 6    status  as  enrolled students or normal student employment at
 7    Southern Illinois University.

10        Sec. 5.  Members of the Board  shall  elect  annually  by
11    secret  ballot  from  their own number a chairperson chairman
12    who shall preside over meetings of the Board and a secretary.
13        Meetings of the Board shall be held at  least  once  each
14    quarter  on a campus of Southern Illinois University.  At all
15    regular meetings of the  Board,  a  majority  of  its  voting
16    members shall constitute a quorum.  The student members shall
17    have all of the privileges of membership, including the right
18    to make and second motions and to attend executive sessions.,
19    other  than the right to vote, except that the student member
20    designated by the Governor as the voting student member shall
21    have the right to vote on  all  Board  matters  except  those
22    involving  faculty  tenure, faculty promotion or any issue on
23    which the student member has a direct conflict  of  interest.
24    A  student member who is not entitled to vote on a measure at
25    a meeting of the Board or any of its committees shall not  be
26    considered  a member for the purpose of determining whether a
27    quorum is present at any meeting of the Board or any  of  its
28    committees the time that measure is voted upon.  No action of
29    the  Board shall be invalidated by reason of any vacancies on
30    the Board, or by reason of any failure to  select  a  student
31    member.
32        Special  meetings  of  the  Board  may  be  called by the
33    chairperson chairman of the Board or by any 3 members of  the

 1    Board.
 2        At  each  regular and special meeting that is open to the
 3    public, members of the public and employees of the University
 4    shall be afforded time, subject to reasonable constraints, to
 5    make comments to or ask questions of the Board.

 8        Section  99.  Effective  date.   This Act takes effect on
 9    July 1, 2003.".
