 1                    AMENDMENT TO SENATE BILL 461

 2        AMENDMENT NO.     .  Amend Senate Bill  461  on  page  1,
 3    line  29 by deleting "opposed unionization by their employees
 4    and"; and

 5    on page 2, by replacing lines 1 through 4 with the following:

 6    "outcome  of  union   representation   elections,   including
 7    requiring employees to attend meetings on work time."; and

 8    on page 2, by replacing line 15 with the following:

 9    "meetings  to  influence  employees regarding unionization.";
10    and

11    on page 4, line 29 by changing "in connection with" to  "that
12    is funded by"; and

13    on page 5, by replacing lines 3 though 9 with the following:

14    "areas."; and

15    by  replacing  lines  31  through  33  on  page 5 and lines 1
16    through 24 on page 6 with the following:

17        "Section 20. Reporting.
18        (a)  Any contractor or grantee who is subject to this Act
19    and who makes expenditures to assist, promote, or deter union

 1    organizing shall maintain records sufficient to show that  no
 2    State funds were used for those expenditures. Expenditures to
 3    be  included  in this record include, but are not limited to,
 4    the cost  of:  literature  or  other  similar  communications
 5    related  to  union  representation;  the  hiring  of vendors,
 6    including  lawyers  and  consultants,  for  the  purpose   of
 7    influencing  a  unionization effort; the holding of meetings,
 8    including meetings with supervisors and managerial employees,
 9    to influence employees regarding unionization; and the  wages
10    of employees, including supervisory and management employees,
11    during  any  activity  aimed  at  influencing  a unionization
12    effort or the preparation for the activity.
13        (b)  Any taxpayer, employee, or  employee  representative
14    may  file  a  complaint with the Illinois Attorney General if
15    the person believes that a contractor or grantee is expending
16    funds in violation of this Act. The Illinois Attorney General
17    shall, within 10 business days after a  complaint  is  filed,
18    notify  the  contractor  or  grantee  that  the contractor or
19    grantee must provide the records described in subsection (a).
20    The contractor or grantee shall provide the  records  to  the
21    Illinois  Attorney  General within 15 business days after the
22    contractor or grantee receives the notice from  the  Illinois
23    Attorney  General, unless the Illinois Attorney General gives
24    the contractor or grantee  a  10-day  extension  of  time  to
25    provide  the  records  based upon a showing of good cause for
26    the extension by the contractor or grantee. If  the  Illinois
27    Attorney  General  determines  that the contractor or grantee
28    has expended funds in violation of  this  Act,  the  Illinois
29    Attorney  General  shall  make  the  records available to the
30    complainant.".
