AMENDMENT TO HOUSE BILL 4572

2     AMENDMENT NO. ______. Amend House Bill 4572, AS AMENDED, in
3 Section 5, by replacing all of subsection (h) of Sec. 3 as
4 follows:

6     "(h) "Dependent", when the term is used in the context of
7 the health and life plan, means a member's spouse and any
8 unmarried child (1) from birth to age 19 including an adopted
9 child, a child who lives with the member from the time of the
10 filing of a petition for adoption until entry of an order of
11 adoption, a stepchild or recognized child who lives with the
12 member in a parent-child relationship, or a child who lives
13 with the member if such member is a court appointed guardian of
14 the child, or (2) age 19 to 23 enrolled as a full-time student
15 in any accredited school, financially dependent upon the
16 member, and eligible to be claimed as a dependent for income
17 tax purposes, or (3) age 19 or over who has a mental or
18 physical disability, is financially dependent upon the member,
19 and is eligible to be claimed as a dependent for income tax
20 purposes. Disability for purposes of this Act may be, but is
21 not required to be, proved by a showing that a dependent is
22 eligible to receive disability benefits under the federal
23 Social Security Act is mentally or physically handicapped. For
24 the health plan only, the term "dependent" also includes any
25 person enrolled prior to the effective date of this Section who
26 is dependent upon the member to the extent that the member may

1 claim such person as a dependent for income tax deduction
2 purposes; no other such person may be enrolled. For the health
3 plan only, the term "dependent" also includes any person who
4 has received after June 30, 2000 an organ transplant and who is
5 financially dependent upon the member and eligible to be
6 claimed as a dependent for income tax purposes. For purposes of
7 the health plan, the term "dependent" shall be liberally
8 construed by the courts and by the Department in a manner that
9 assures adequate health care for children and persons with
10 disabilities.".
