 1        AN  ACT  concerning  the   Department   of   Professional
 2    Regulation.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Department of Professional Regulation Law
 6    of the Civil Administrative Code of Illinois  is  amended  by
 7    adding Section 2105-350 as follows:

 8        (20 ILCS 2105/2105-350 new)
 9        Sec.   2105-350.   License   examination   administration
10    services  contracts.  The Department's procurement of license
11    examination  administration  services  is  subject   to   the
12    Illinois  Procurement  Code,  including  but  not  limited to
13    Section 20-115 of that Code.

14        Section 10.  The Illinois Procurement Code is amended  by
15    adding Section 20-115 as follows:

16        (30 ILCS 500/20-115 new)

17        Sec.  20-115.  Licensure examination services.  Contracts
18    for services involving licensure  examination  administration
19    and  related  services  shall meet the provisions of this Act
20    regardless of  the  source  of  funding  including,  but  not
21    limited to, fees paid by the licensure applicant. In addition
22    to  any other provisions requested by the administering state
23    agency, requests  for  proposals  for  licensure  examination
24    administration   and   related  services  shall  include  the
25    following:
26             (1)  the  ability  of  the  vendor  to  provide  the
27        examination in a computerized format, if requested by the
28        licensure applicant; and

 1             (2)  the  ability  of  the  vendor  to  update   the
 2        examination  a  minimum  of once every 4 years to reflect
 3        the  current  practice,  current  teaching  methods,  and
 4        current  reference  materials  and  text  books  for  the
 5        profession being assessed.
 6        In selecting  the  licensure  examination  administration
 7    provider,  the  cost of the examination paid by the licensure
 8    applicant shall be considered.
