 1                    AMENDMENT TO HOUSE BILL 3411

 2        AMENDMENT NO.     .  Amend House Bill 3411  by  replacing
 3    lines  26  through 31 on page 1 and line 1 on page 2 with the
 4    following:
 5        "(b)  The Chairman of  the  County  Board  of  St.  Clair
 6    County  shall appoint a commissioner for the term expiring in
 7    January, 2004 and in the following year the Chairman  of  the
 8    County  Board  of Madison County shall appoint a commissioner
 9    for the term expiring in January  of  that  year.  Successive
10    appointments  shall alternate between the Chairman of the St.
11    Clair County Board and the Chairman  of  the  Madison  County
12    Board,  except  as  may  be  modified  by  the  provisions of
13    subsection (c).
14        (c)  In the event that a tax has been imposed  in  Monroe
15    County  consistent with the provisions of Section 5.01 of the
16    Local Mass Transit District Act, the Chairman of  the  Monroe
17    County  Board  shall,  upon  the  expiration of the term of a
18    commissioner who is a resident of the County in  which  3  of
19    the   then   remaining   commissioners   reside,   appoint  a
20    commissioner with the advice and consent of the Monroe County
21    Board. The commissioner appointed by the Monroe County  Board
22    shall hold office for a term of 5 years and a successor shall
23    be appointed by the chairman of the Monroe County Board, with
24    the  advice  and  consent  of  the  Monroe  County Board. The

 1    appointments of the  4  remaining  commissioners  shall  then
 2    continue to alternate between St. Clair and Madison County so
 3    that each County shall continue to retain the appointments of
 4    2  commissioners.   To  the  extent  that this subsection (c)
 5    conflicts with any other provision of this Section or Section
 6    3, the provisions of this subsection (c) control.".
