 1                    AMENDMENT TO HOUSE BILL 1251

 2        AMENDMENT NO.     .  Amend House Bill 1251,  on  page  4,
 3    immediately below line 4, by inserting the following:
 4        "If (i) a township has a plan commission, (ii) the county
 5    board    and    a   municipality   have   entered   into   an
 6    intergovernmental agreement that allows the  municipality  to
 7    exercise  its zoning power beyond its territorial limits, and
 8    (iii) the  township  plan  commission  objects  to  a  zoning
 9    variation   that   affects  an  unincorporated  area  of  the
10    township, then, within  15  days  after  the  public  hearing
11    before  the  board  of  appeals  on the zoning variation, the
12    township board of trustees may submit its written  objections
13    to  the  clerk of the municipality. If the written objections
14    are filed, then the corporate authorities may not approve the
15    zoning variation except by the favorable vote of 3/4  of  all
16    of the corporate authorities.".
