 1                     AMENDMENT TO HOUSE BILL 318

 2        AMENDMENT NO.     .  Amend House Bill 318 as follows:

 3    on  page  1,  by  replacing  lines  7  through  11  with  the
 4    following:
 5        ""Under the  control"  means  within  the  reach  of  the
 6    cashier  or  protected  by  other  security, surveillance, or
 7    detection methods, including but not  limited  to  electronic
 8    scanners.
 9        "Within  the line of sight" means visible to a cashier or
10    other employee, whether directly or by means  of  mirrors  or
11    monitors.
12        "Tobacco  specialty store" means a business establishment
13    devoted primarily to the sale of tobacco,  tobacco  products,
14    and  accessories  and  in which the sale of other products is
15    incidental."; and

16    by replacing lines 17 through  30  on  page  1  and  lines  1
17    through 6 on page 2 with the following:

18        "Section 10. Tobacco product displays. It is unlawful for
19    any  person  who  sells  tobacco products over the counter to
20    maintain  such  products  in  any  location   accessible   to
21    customers  that is not within the line of sight, or under the
22    control, of  a  cashier  or  other  employee  during  regular

 1    business hours, except that this condition does not apply to:
 2    (i) business establishments to which persons under the age of
 3    18 are not admitted or to which such persons are not admitted
 4    unless  accompanied  by  a  parent  or  other  adult, or (ii)
 5    tobacco specialty stores.".
