1 AN ACT in relation to credit and debit cards.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2MM as follows:
6 (815 ILCS 505/2MM new)
7 Sec. 2MM. Receipts; credit card and debit card account
8 numbers.
9 (a) Definitions. As used in this Section:
10 "Cardholder" has the meaning ascribed to it in Section
11 2.02 of the Illinois Credit Card and Debit Card Act.
12 "Credit card" has the meaning ascribed to it in Section
13 2.03 of the Illinois Credit Card and Debit Card Act.
14 "Debit card" has the meaning ascribed to it in Section
15 2.15 of the Illinois Credit Card and Debit Card Act.
16 "Issuer" has the meaning ascribed to it in Section 2.08
17 of the Illinois Credit Card and Debit Card Act.
18 "Person" has the meaning ascribed to it in Section 2.09
19 of the Illinois Credit Card and Debit Card Act.
20 "Provider" means a person who furnishes money, goods,
21 services, or anything else of value upon presentation,
22 whether physically, in writing, verbally, electronically, or
23 otherwise, of a credit card or debit card by the cardholder,
24 or any agent or employee of that person.
25 (b) Except as otherwise provided in this Section, no
26 provider may print or otherwise produce or reproduce or
27 permit the printing or other production or reproduction of
28 the following: (i) any part of the credit card or debit card
29 account number, other than the last 4 digits or other
30 characters, (ii) the credit card or debit card expiration
31 date on any receipt provided or made available to the

1 cardholder.
2 (c) This Section does not apply to a credit card or debit
3 card transaction in which the sole means available to the
4 provider of recording the credit card or debit card account
5 number is by handwriting or by imprint of the card.
6 (d) This Section does not apply to receipts issued for
7 transactions on the electronic benefits transfer card system
8 in accordance with 7 CFR 274.12(g)(3).
9 (e) A violation of this Section constitutes an unlawful
10 practice within the meaning of this Act.
11 (f) This Section is operative on January 1, 2005.
