SYNOPSIS AS INTRODUCED:
 
30 ILCS 535/30  from Ch. 127, par. 4151-30

    Amends the Architectural, Engineering, and Land Surveying Qualifications Based Selection Act. Provides that the term of any member of a selection committee created by the Department of Transportation to select firms to provide architectural, engineering, and land surveying services prior to January 1, 2022 shall be terminated on December 31, 2021. Provides that beginning on or after January 1, 2022, the Department of Transportation shall appoint selection committees consisting of 9 members who shall be appointed with the advice and consent of the Senate. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Architectural, Engineering, and Land
5Surveying Qualifications Based Selection Act is amended by
6changing Section 30 as follows:
 
7    (30 ILCS 535/30)  (from Ch. 127, par. 4151-30)
8    Sec. 30. Evaluation procedure. A State agency shall
9evaluate the firms submitting letters of interest and other
10prequalified firms, taking into account qualifications; and
11the State agency may consider, but shall not be limited to
12considering, ability of professional personnel, past record
13and experience, performance data on file, willingness to meet
14time requirements, location, workload of the firm and any
15other qualifications based factors as the State agency may
16determine in writing are applicable. The State agency may
17conduct discussions with and require public presentations by
18firms deemed to be the most qualified regarding their
19qualifications, approach to the project and ability to furnish
20the required services.
21    A State agency shall establish a committee to select firms
22to provide architectural, engineering, and land surveying
23services. A selection committee may include at least one

1public member nominated by a statewide association of the
2profession affected. The public member may not be employed or
3associated with any firm holding a contract with the State
4agency nor may the public member's firm be considered for a
5contract with that State agency while he or she is serving as a
6public member of the committee.
7    In addition, the Department of Transportation may appoint
8public members to selection committees that represent the
9geographic, ethnic, and cultural diversity of the population
10of the State, including persons nominated by associations
11representing minority and female-owned business associations.
12Public members shall be licensed in or have received a degree
13from an accredited college or university in one of the
14professions affected and shall not be employed by, associated
15with, or have an ownership interest in any firm holding or
16seeking to hold a contract while serving as a public member of
17the committee.
18    The term of any member of a selection committee created by
19the Department of Transportation under the provisions of this
20Section prior to January 1, 2022 shall be terminated on
21December 31, 2021. Beginning on or after January 1, 2022, the
22Department of Transportation shall appoint members to serve on
23selection committees to select firms to provide architectural,
24engineering, and land surveying services. In addition to the
25requirements of this Section, the selection committees shall
26consist of 9 members who shall be appointed with the advice and

1consent of the Senate.
2    In no case shall a State agency, prior to selecting a firm
3for negotiation under Section 40, seek formal or informal
4submission of verbal or written estimates of costs or
5proposals in terms of dollars, hours required, percentage of
6construction cost, or any other measure of compensation.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
