SYNOPSIS AS INTRODUCED:
 
ILCON Art. V, Sec. 1
ILCON Art. V, Sec. 22 new
ILCON Art. V, Sec. 3
ILCON Art. V, Sec. 7

    Proposes to amend the Executive Article of the Illinois Constitution. Expands the elected officers, and the qualifications for elected officers, of the Executive Branch to include the Director of Agriculture (currently, the Governor, Lieutenant Governor, Attorney General, Secretary of State, Comptroller, and Treasurer). Provides for filling vacancies in the office of Director of Agriculture. Provides that the Director of Agriculture shall develop, promote, and regulate agriculture in the State, and shall have the duties and powers that may be prescribed by law. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE SENATE OF THE ONE HUNDREDTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to the Illinois Constitution by
9changing Sections 1, 3, and 7 and adding Section 22 to Article
10V as follows:

THE EXECUTIVE

13    (ILCON Art. V, Sec. 1)
14SECTION 1. OFFICERS
15    The Executive Branch shall include a Governor, Lieutenant
16Governor, Attorney General, Secretary of State, Comptroller,
17and Treasurer, and Director of Agriculture elected by the
18electors of the State. They shall keep the public records and
19maintain a residence at the seat of government during their
20terms of office.

1SECTION 3. ELIGIBILITY
2    To be eligible to hold the office of Governor, Lieutenant
3Governor, Attorney General, Secretary of State, Comptroller,
4or Treasurer, or Director of Agriculture, a person must be a
5United States citizen, at least 25 years old, and a resident of
6this State for the three years preceding his election.

9SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
10    If the Attorney General, Secretary of State, Comptroller,
11or Treasurer, or Director of Agriculture fails to qualify or if
12his office becomes vacant, the Governor shall fill the office
13by appointment. The appointee shall hold office until the
14elected officer qualifies or until a successor is elected and
15qualified as may be provided by law and shall not be subject to
16removal by the Governor. If the Lieutenant Governor fails to
17qualify or if his office becomes vacant, it shall remain vacant
18until the end of the term.

21SECTION 22. DIRECTOR OF AGRICULTURE-DUTIES
22    The Director of Agriculture shall develop, promote, and
23regulate agriculture in the State, and shall have the duties
24and powers that may be prescribed by law.

SCHEDULE
2    This Constitutional Amendment takes effect upon being
3declared adopted in accordance with Section 7 of the Illinois
4Constitutional Amendment Act.
