SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/24-4  from Ch. 38, par. 24-4

    Amends the Criminal Code of 2012. Provides that any federal firearms licensee, other than a licensed collector of curios and relics, when he or she operates from a permanent place of business shall maintain a security system that either: (1) maintains video surveillance on each entrance and exit; or (2) is connected to an alarm monitoring system that will notify local law enforcement of an unauthorized intrusion into the licensee's place of business. Provides that any federal firearms licensee, other than a licensed collector of curios and relics, may not allow any employee to conduct a sale or transfer of a firearm if that person does not possess a valid Firearm Owner's Identification Card or concealed carry license. Provides that if the employee is exempt from the requirement, as a condition of acquiring or possessing a firearm, of having in his or her possession a valid Firearm Owner's Identification Card under the Firearm Owners Identification Card Act, the seller shall ensure the employee is not prohibited under State or federal law from possessing a firearm. Provides that any federal firearms licensee, other than a licensed collector of curios and relics, shall ensure that any person who sells or conducts transfers of firearms shall receive at least 2 hours of training on the laws governing the sale and transfer of firearms during the duration of the license. Provides that a violation is a Class B misdemeanor.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 24-4 as follows:
 
6    (720 ILCS 5/24-4)  (from Ch. 38, par. 24-4)
7    Sec. 24-4. Sales by dealer. Register of sales by dealer.
8    (a) Any seller of firearms of a size which may be concealed
9upon the person, other than a manufacturer selling to a bona
10fide wholesaler or retailer or a wholesaler selling to a bona
11fide retailer, shall keep a register of all firearms sold or
12given away.
13    (b) Such register shall contain the date of the sale or
14gift, the name, address, age and occupation of the person to
15whom the weapon is sold or given, the price of the weapon, the
16kind, description and number of the weapon, and the purpose for
17which it is purchased and obtained.
18    (c) Such seller on demand of a peace officer shall produce
19for inspection the register and allow such peace officer to
20inspect such register and all stock on hand.
21    (c-1) Any federal firearms licensee, other than a licensed
22collector of curios and relics, when he or she operates from a
23permanent place of business shall maintain a security system

1that either:
2        (1) maintains video surveillance on each entrance and
3    exit; or
4        (2) is connected to an alarm monitoring system that
5    will notify local law enforcement of an unauthorized
6    intrusion into the licensee's place of business.
7    (c-2) Any federal firearms licensee, other than a licensed
8collector of curios and relics, may not allow any employee to
9conduct a sale or transfer of a firearm if that person does not
10possess a valid Firearm Owner's Identification Card or
11concealed carry license. If the employee is exempt from the
12requirement, as a condition of acquiring or possessing a
13firearm, of having in his or her possession a valid Firearm
14Owner's Identification Card previously issued in his or her
15name by the Department of State Police under the Firearm Owners
16Identification Card Act, the seller shall ensure the employee
17is not prohibited under State or federal law from possessing a
18firearm.
19    (c-3) Any federal firearms licensee, other than a licensed
20collector of curios and relics, shall ensure that any person
21who sells or conducts transfers of firearms shall receive at
22least 2 hours of training on the laws governing the sale and
23transfer of firearms during the duration of the license.
24    (d) Sentence.
25    Violation of this Section is a Class B misdemeanor.
