1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Police Act is amended by changing
5Section 9 as follows:
 
6    (20 ILCS 2610/9)  (from Ch. 121, par. 307.9)
7    Sec. 9. Appointment; qualifications.
8    (a) Except as otherwise provided in this Section, the
9appointment of Department of State Police officers shall be
10made from those applicants who have been certified by the Board
11as being qualified for appointment. All persons so appointed
12shall, at the time of their appointment, be not less than 21
13years of age, or 20 years of age and have successfully
14completed 2 years of law enforcement studies at an accredited
15college or university. Any person appointed subsequent to
16successful completion of 2 years of such law enforcement
17studies shall not have power of arrest, nor shall he be
18permitted to carry firearms, until he reaches 21 years of age.
19In addition, all persons so certified for appointment shall be
20of sound mind and body, be of good moral character, be citizens
21of the United States, have no criminal records, possess such
22prerequisites of training, education and experience as the
23Board may from time to time prescribe, and shall be required to

1pass successfully such mental and physical tests and
2examinations as may be prescribed by the Board. Notwithstanding
3any Board rule to the contrary, all persons who meet one of the
4following requirements are deemed to have met the collegiate
5educational requirements either:
6                (i) have been honorably discharged and who
7            have been awarded a Southwest Asia Service Medal,
8            Kosovo Campaign Medal, Korean Defense Service
9            Medal, Afghanistan Campaign Medal, Iraq Campaign
10            Medal, or Global War on Terrorism Expeditionary
11            Medal by the United States Armed Forces; or
12                (ii) are active members of the Illinois
13            National Guard or a reserve component of the United
14            States Armed Forces and who have been awarded a
15            Southwest Asia Service Medal, Kosovo Campaign
16            Medal, Korean Defense Service Medal, Afghanistan
17            Campaign Medal, Iraq Campaign Medal, or Global War
18            on Terrorism Expeditionary Medal as a result of
19            honorable service during deployment on active
20            duty; ,
21                (iii) have been honorably discharged who
22            served in a combat mission by proof of hostile fire
23            pay or imminent danger pay during deployment on
24            active duty; or
25                (iv) have at least 3 years of full active and
26            continuous military duty and received an honorable

1            discharge before hiring. are deemed to have met the
2            collegiate educational requirements.
3    Preference shall be given in such appointments to persons
4who have honorably served in the military or naval services of
5the United States. All appointees shall serve a probationary
6period of 12 months from the date of appointment and during
7that period may be discharged at the will of the Director.
8However, the Director may in his or her sole discretion extend
9the probationary period of an officer up to an additional 6
10months when to do so is deemed in the best interest of the
11Department.
12    (b) Notwithstanding the other provisions of this Act, after
13July 1, 1977 and before July 1, 1980, the Director of State
14Police may appoint and promote not more than 20 persons having
15special qualifications as special agents as he deems necessary
16to carry out the Department's objectives. Any such appointment
17or promotion shall be ratified by the Board.
18    (c) During the 90 days following the effective date of this
19amendatory Act of 1995, the Director of State Police may
20appoint up to 25 persons as State Police officers. These
21appointments shall be made in accordance with the requirements
22of this subsection (c) and any additional criteria that may be
23established by the Director, but are not subject to any other
24requirements of this Act. The Director may specify the initial
25rank for each person appointed under this subsection.
26    All appointments under this subsection (c) shall be made

1from personnel certified by the Board. A person certified by
2the Board and appointed by the Director under this subsection
3must have been employed by the Illinois Commerce Commission on
4November 30, 1994 in a job title subject to the Personnel Code
5and in a position for which the person was eligible to earn
6"eligible creditable service" as a "noncovered employee", as
7those terms are defined in Article 14 of the Illinois Pension
8Code.
9    Persons appointed under this subsection (c) shall
10thereafter be subject to the same requirements and procedures
11as other State police officers. A person appointed under this
12subsection must serve a probationary period of 12 months from
13the date of appointment, during which he or she may be
14discharged at the will of the Director.
15    This subsection (c) does not affect or limit the Director's
16authority to appoint other State Police officers under
17subsection (a) of this Section.

19    Section 99. Effective date. This Act takes effect July 1,
202017.
