SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Farmers' Market Act. Provides that the Department of Public Health shall develop a permit system for farmers' markets in accordance with the laws and rules of the State that are applicable to farmers' markets. Provides that each local health department shall monitor farmers' markets for compliance with the provisions of the Act. Provides that each local health department shall report permit violations to the Department. Provides that the Department shall be responsible for imposing appropriate sanctions for permit violations. Provides that, in addition to any other applicable law or rule, farmers' markets shall be subject to specified provisions. Defines "farmers' market".

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Farmers' Market Act.
 
6    Section 5. For the purposes of this Act:
7    "Department" means the Department of Public Health.
8    "Farmers' market" means a common facility or area where
9farmers gather to sell a variety of fresh fruits and vegetables
10and other locally produced farm and food products directly to
11consumers.
 
12    Section 10. Applicable laws. In addition to any other
13applicable law or rule, farmers' markets shall be subject to
14the provisions of:
15        (1) the Bees and Apiaries Act;
16        (2) the Farm Products Marketing Act;
17        (3) the Food Handling Regulation Enforcement Act;
18        (4) the Food Service Sanitation Code, 77 Ill. Adm. Code
19    750;
20        (5) the Grade A Pasteurized Milk and Milk Products Act;
21        (6) the Illinois Egg and Egg Products Act;
22        (7) the Illinois Food, Drug and Cosmetic Act;

1        (8) the Meat and Poultry Inspection Act; and
2        (9) the Sanitary Food Preparation Act.
 
3    Section 15. Permits. The Department shall develop a permit
4system for farmers' markets in accordance with the laws and
5rules of this State that are applicable to farmers' markets.
6Each local health department shall monitor farmers' markets for
7compliance with the provisions of this Act. Each local health
8department shall report any permit violation under this Section
9to the Department. The Department shall be responsible for
10imposing appropriate sanctions for permit violations.
