New Act

Creates the Violent Gun Offender Sentencing Act. Contains only short title and purpose provisions.

A BILL FOR

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Violent Gun Offender Sentencing Act.

Section 5. Purpose. The General Assembly recognizes that a significant amount of gun violence is committed by individuals with prior criminal histories involving violence and firearms. This Act creates data-driven presumptive guidelines within existing sentencing ranges to target the most serious penalties towards offenders who have histories of violence and gun crime, while maintaining judicial discretion in the interest of justice. The goal of these presumptive guidelines is to provide additional guidance to the court, to ensure that sentences for repeat, violent gun offenders reflect the seriousness of those offenses.
