SYNOPSIS AS INTRODUCED:
 
20 ILCS 1605/20  from Ch. 120, par. 1170

    Amends the Illinois Lottery Law. Provides that, if for any reason the General Assembly fails to make appropriations of amounts sufficient from the State Lottery Fund to the Department for payment of prizes to holders of winning lottery tickets or shares, including prizes related to Multi-State Lottery games, and payment of promotional or incentive prizes associated with the sale of lottery tickets, then the provision constitutes an irrevocable and continuing appropriation of all amounts necessary for that purpose, and the irrevocable and continuing authority for and direction to the Comptroller and to the Treasurer of the State to make the necessary transfers out of and disbursements from the State Lottery Fund for that purpose. Specifies that the revenues received from the sale of lottery tickets or shares is net of, among other things, sales agent commissions (rather than commissions) and any private manager compensation or reimbursements due under the management agreement. Effective immediately.

1    AN ACT concerning the lottery.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 20 as follows:
 
6    (20 ILCS 1605/20)  (from Ch. 120, par. 1170)
7    Sec. 20. State Lottery Fund.
8    (a) There is created in the State Treasury a special fund
9to be known as the "State Lottery Fund". Such fund shall
10consist of all revenues received from (1) the sale of lottery
11tickets or shares, (net of sales agent commissions, fees
12representing those expenses that are directly proportionate to
13the sale of tickets or shares at the agent location, and prizes
14of less than $600 which have been validly paid at the agent
15level, and any private manager compensation or reimbursements
16due under the management agreement), (2) application fees, and
17(3) all other sources including moneys credited or transferred
18thereto from any other fund or source pursuant to law. Interest
19earnings of the State Lottery Fund shall be credited to the
20Common School Fund.
21    (a-5) If for any reason the General Assembly fails to make
22appropriations of amounts sufficient from the State Lottery
23Fund to the Department for payment of prizes to holders of

4pursuant to the provisions of this Law, then this subsection
5constitutes an irrevocable and continuing appropriation of all
6amounts necessary for that purpose, and the irrevocable and
7continuing authority for and direction to the Comptroller and
8to the Treasurer of the State to make the necessary transfers
9out of and disbursements from the State Lottery Fund for that
10purpose.
11    (b) The receipt and distribution of moneys under Section
1221.5 of this Act shall be in accordance with Section 21.5.
13    (c) The receipt and distribution of moneys under Section
1421.6 of this Act shall be in accordance with Section 21.6.
15    (d) The receipt and distribution of moneys under Section
1621.7 of this Act shall be in accordance with Section 21.7.
17    (e) The receipt and distribution of moneys under Section
1821.8 of this Act shall be in accordance with Section 21.8.
19    (f) The receipt and distribution of moneys under Section
2021.9 of this Act shall be in accordance with Section 21.9.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.
