SYNOPSIS AS INTRODUCED:

225 ILCS 10/4.7 new

Amends the Child Care Act of 1969. Requires the Department of Children and Family Services to amend the Illinois Administrative Code to improve the efficiency in oversight and licensing of group homes. Requires the rules to align with existing procedures and policies governed by the community-integrated living arrangement services requirements and to include specific subjects. Effective immediately.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Child Care Act of 1969 is amended by adding Section 4.7 as follows:

(225 ILCS 10/4.7 new)

Sec. 4.7. Streamline licensing, oversight, and certification of children's group homes. No later than 90 days after the effective date of this Act, the Department shall adopt amendments to 89 Ill. Adm. Code 403 seeking to improve the efficiency in oversight and licensing of group homes. The amendments shall include, but are not limited to, aligning the following with existing procedures and policies governed by the community-integrated living arrangement services governed by 59 Ill. Adm. Code 115:

(1) initial licensure and renewal of group home providers, not individual group homes;

(2) removal of the requirement for group homes to be certified by health departments;

(3) approval of support staff to work in multiple group homes under the same license, not requiring staff to be approved for each individual group home;

(4) for staff working in group homes primarily serving children with developmental disabilities, establish a direct support staff training curriculum that mirrors the training requirements for staff performing similar work in community-integrated living arrangement settings;

(5) allow physician assistants to examine and sign new staff physical forms; and

(6) modify and expedite the process to approve driver permits.

Section 99. Effective date. This Act takes effect upon becoming law.
