1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Mandates Act is amended by changing
5Section 7 as follows:
 
6    (30 ILCS 805/7)  (from Ch. 85, par. 2207)
7    Sec. 7. Review of Existing Mandates.
8    (a) Beginning with the 2019 catalog and every other year
9thereafter, concurrently Concurrently with, or within 3 months
10subsequent to the publication of a catalog of State mandates as
11prescribed in subsection (b) of Section 4 the Department shall
12submit to the Governor and the General Assembly a review and
13report on mandates enacted in the previous 2 years prior to the
14effective date of this Act and remaining in effect at the time
15of submittal of the report. The Department may fulfill its
16responsibilities for compiling the report by entering into a
17contract for service.
18    Beginning with the 2017 catalog and every 10 years
19thereafter, concurrently with, or within 3 months subsequent to
20the publication of a catalog of State mandates as prescribed in
21subsection (b) of Section 4, the Department shall submit to the
22Governor and the General Assembly a review and report on all
23effective mandates at the time of submittal of the reports.

1    (b) The report shall include for each mandate the
2following: (1) The factual information specified in subsection
3(b) of Section 4 for the catalog. ; The report may also include
4the following: (1) (2) extent to which the enactment of the
5mandate was requested, supported, encouraged or opposed by
6local governments or their respective organization; (2) (3)
7whether the mandate continues to meet a Statewide policy
8objective or has achieved the initial policy intent in whole or
9in part; (3) (4) amendments if any are required to make the
10mandate more effective; (4) (5) whether the mandate should be
11retained or rescinded; (5) (6) whether State financial
12participation in helping meet the identifiable increased local
13costs arising from the mandate should be initiated, and if so,
14recommended ratios and phasing-in schedules; and (6) (7) any
15other information or recommendations which the Department
16considers pertinent; and (7) any comments about the mandate
17submitted by affected units of government.
18    (c) The appropriate committee of each house of the General
19Assembly shall review the report and shall initiate such
20legislation or other action as it deems necessary.
21    The requirement for reporting to the General Assembly shall
22be satisfied by filing copies of the report with the Speaker,
23the Minority Leader and the Clerk of the House of
24Representatives and the President, the Minority Leader, the
25Secretary of the Senate, the members of the committees required
26to review the report under subsection (c) and the Legislative

1Research Unit, as required by Section 3.1 of "An Act to revise
2the law in relation to the General Assembly", approved February
325, 1874, as amended, and filing such additional copies with
4the State Government Report Distribution Center for the General
5Assembly as is required under paragraph (t) of Section 7 of the
6State Library Act.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
