SYNOPSIS AS INTRODUCED:
 
50 ILCS 750/8.5 new

    Amends the Emergency Telephone Systems Act. Provides that if a public safety agency, public agency, qualified governmental entity, or Emergency Telephone System Board submits an affidavit to the Illinois Commerce Commission stating the amount of expenses for services that the responding agency has incurred because an employee or designee of a public safety agency was required to physically transfer 9-1-1 calls at the private branch exchange due to a failure by a system provider's trunk line, the Commission shall immediately reimburse the responding agency in the amount stated in the affidavit or $1,000.00, whichever is less. Provides that if there are expenses requested greater than the amount the Commission immediately reimbursed, then the Commission shall provide full reimbursement to the responding agency within 90 days of receipt of an affidavit requesting the additional reimbursement. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Telephone System Act is amended by
5adding Section 8.5 as follows:
 
6    (50 ILCS 750/8.5 new)
7    Sec. 8.5. Reimbursement for physical transfer of 9-1-1
8calls.
9    (a) For purposes of this Section:
10        "Responding agency" means a public safety agency,
11    public agency, qualified governmental entity, or Emergency
12    Telephone System Board.
13    (b) If a responding agency submits an affidavit to the
14Commission stating the amount of expenses for services that the
15responding agency has incurred because an employee or designee
16of a public safety agency was required to physically transfer
179-1-1 calls at the private branch exchange due to a failure by
18a system provider's trunk line, the Commission shall
19immediately reimburse to the responding agency in the amount
20stated in the affidavit or $1,000.00, whichever is less.
21    (c) If the amount of expenses for services that the
22responding agency has incurred is greater than the amount
23reimbursed pursuant to subsection (b), then the Commission

1shall reimburse the responding agency for the unreimbursed
2amount of expenses within 90 days of receipt of the affidavit
3submitted pursuant to subsection (b) or within 90 days of
4receipt of an additional affidavit stating the amount of
5additional expenses incurred by the responding agency in
6addition to the amount reimbursed pursuant to subsection (b).

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
