SYNOPSIS AS INTRODUCED:
 
New Act
30 ILCS 105/5.875 new

    Creates the Gun Buyback Program Act. Provides that the Department of State Police and the State's Attorneys of this State shall establish a gun trade-in program in which events are held in each county of this State, once per year in each county, to buy back from any person a firearm, gun, rifle, shotgun, or other similar weapon for a nominal fee. The Department of State Police and representatives of the State's Attorney who are present at a Gun Buyback Program event shall not question any person regarding the documentation of the firearm, gun, rifle, shotgun, or other similar weapon presented, such as if the person has a valid firearm owner's identification card or concealed carry license, or request proper registration for the firearm, gun, rifle, shotgun, or other similar weapon. Amends the State Finance Act to create the Gun Buyback Fund as a special fund in the State treasury.

1    AN ACT concerning the firearms.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Gun
5Buyback Program Act.
 
6    Section 5. Gun Buyback Program. An authorized gun trade-in
7program shall be established by the Department of State Police
8and the State's Attorneys of this State. The Gun Buyback
9Program shall hold events in each county of this State, at
10least once a year, to buy back any firearm, gun, rifle,
11shotgun, or other similar weapon from any person. The
12Department of State Police and representatives of the State's
13Attorney who are present at a Gun Buyback Program event shall
14not question any person regarding the documentation of the
15firearm, gun, rifle, shotgun, or other similar weapon
16presented, such as if the person has a valid firearm owner's
17identification card or concealed carry license, or request
18proper registration for the firearm, gun, rifle, shotgun, or
19other similar weapon. The Department of State Police and the
20State's Attorney representatives shall collect any firearm,
21gun, rifle, shotgun, or other similar weapon and buy the gun
22back from the person who presented it for a nominal fee.

1    Section 10. Funding. The Gun Buyback Fund is created as a
2special fund in the State treasury consisting of moneys
3transferred from the General Revenue Fund. All money in the Gun
4Buyback Fund shall be used, subject to appropriation, by the
5Department of State Police for the purpose of administering Gun
6Buyback Program events throughout the State and giving a person
7a nominal price for the return of a firearm, gun, rifle,
8shotgun, or other similar weapon presented at a Gun Buyback
9Program event held in this State.
 
10    Section 50. Rules. The Department of State Police may adopt
11any rules necessary to implement this Act.
 
12    Section 80. The State Finance Act is amended by adding
13Section 5.875 as follows:
