SYNOPSIS AS INTRODUCED:
 
50 ILCS 205/25 new

    Amends the Local Records Act. Provides that an agency or commission may not destroy any public record, nonrecord material, or material not included within the definition of records as contained in this Act concerning complaints, investigations, and adjudications of police officer misconduct. Further provides that an agency shall permanently retain such records and materials. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Records Act is amended by adding
5Section 25 as follows:
 
6    (50 ILCS 205/25 new)
7    Sec. 25. Complaints of police officer misconduct.
8Notwithstanding any law to the contrary, an agency or
9commission may not destroy any public record, nonrecord
10material, or material not included within the definition of
11records as contained in this Act concerning complaints,
12investigations, and adjudications of police officer
13misconduct. An agency shall permanently retain such records and
14materials. For purposes of this Section, "police officer" shall
15include State Police officers and police officers of a unit of
16local government.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
